  • DSAR/CCA confusion????

    i have four debts in the hands of lowell portfolio. one is a credit card bill, two are mobile phone contract termination and one is a student overdraft.

    i sent CCA requests for all of them a few months ago and havent heard anything back from any of them. i also sent a DSAR for the overdraft a couple of weeks ago.

    lowell responded to my DSAR and gave me alot of info that basically told me when they tried to contact me and final bills for all four of the debts. although i was only enquiring about the overdraft.

    my question is........is do they still need to respond to my CCA requests before the debt is enforceable????

    i have not received any DN's or any information I deem relevant

    Yes they are required to respond to your CCA requests. It is a separate thing to the DSAR, and under the consumer credit act if they do not sent compliant agreements within the 12+2 days timescales laid out they are barred against enforcement of the debts until such time as they do supply the documents requested. It only applies to the Credit Card though.

    The SAR stuff should be useful too - does it give you much information to help sorting out the overdraft or mobile phone debts ?

      thanks for getting back to me.

      the information i have received from the DSAR is not exactly what i was expecting and not all of what i asked for.

      i think they are mostly SB. but all i have received is a copy of correspondence between us, a copy of their notes from their automated collections system and a copy of the information that they received from the original creditor at the point the debt was assigned to them.

      the overdraft has been put on hold while they await the documentation from the bank.

      there is no DN's, no NOA's, no CCA's. it just seems very limited to me.

      is this all that is required of them???
