    Hi,
    I have just had a SD withdrawn by the claimant after his solicitor read our 'Application to Set-aside' and witness statements. What is the likelihood of them now issuing a CC claim?

    Good news. Without knowing anything about the debt that the SD was for, or the reasons for the setaside application it is hard to say.

      Hi,
      I was being pursued as a guarantor on a commercial lease. However, when the barrister looked into it he found that the leases had not been registered and they had also been varied without my permission. My solicitor used this information for the application to set-aside. Does that help at all? The total claim is in the region of £29k

        Well it is tough to say what the claimants will do - it is easier to have a Stat Demand withdrawn as there pretty much has to be 100% evidence of the debt not being disputed. If they bought a court claim you would be able to enter your defence and possibly enter mediation/negotiations if necessary. They are entitled to bring a county court action, but will still be required to prove their claim with the same documentation your barrister has already seen.
