My wife and I attended court on Xmas eve last year regarding outstanding School fees which amounted to approx. £22,000.
I suffered a from a brain haemorrhage and lost my job subsequently couldn't pay the fees we tried to negotiate with the school however they placed the matter with a Debt collection agency who would only agree to a minimum amount of £1000 per month repayment plan which clearly was impossible until such time I return to full time work.
We attended court and explain our side of the story to he Judge he asked about the cost and how these were calculated however the solicitor in attendance could not provide that information despite a brief adjournment to call his firm. Upon return he said that he was unable to provide the breakdown and said that he firm "solicitor" would consider a payment plan this also was indicated by the Judge that he would be looking at a payment plan as well. The Judge reduced the legal costs that the firm of solicitors were charging from £1000 to £400 also he reduced the cost of the claim from £22000 to £17000 the increase were charges added on by the Debt collection company who work on behalf of the school.
When my wife and I asked about the bankruptcy petition being dropped he said sadly that as it was Xmas eve most law firms would be close from now on (Our case was heard at 12noon Xmas eve)
On the 6th January we wrote to the Solicitors saying confirming that we would like to enter into a payment plan as agreed on the 24th and the Judge also said that he would be looking at a payment plan.
In the letter of the 6th Jan we said that we look forward to your reply however we have not received anything back from the law firm. I have called to speak with someone and in all fairness a solicitor has called me back and left a message to say that he called this was just under two weeks ago.
I have return his call leaving both my home number and mobile on my last call I spoke to a lady possibly secretary she replied did I attend court the other day 18th Feb. Now I am panicking because we were given a notice to attend court regarding this insolvency some weeks ago however I believed rightly or wrongly that this matter was no longer an issue. Well today I was proven wrong and it feels like my whole world is collapsing the receiver has called and said that judgement has been made.....!
I asked if I had a right to appeal he said that possibly an annulment could be considered if there were correct grounds for this.
I feel sick in my stomach and deeply concerned about losing our house as I have two young children ages 7&9.
Why Why Why has this law firm done this as if its not be difficult enough for us after my illness I don't understand why they never replied to us I sent our letter by recorded delivery.
I am trying to get back to full time work and have an interview in Liverpool on Monday this whole thing feels as fragile as a house of cards.
Can anyone please please advise me on what to do
