    I have retrieved credit card statements from the cobwebs and it would seem the card was taken out in either late 2000 or early 2001, I believe by a mailshot although I am unsure at this time. I believe the last payment to Lloyds TSB was late 2011. Various letters started shortly after and it went from pillar to post.
    Okay so it isn't Statute Barred, but if they don't come back with a decently compliant agreement they will not be able to enforce the debt (ie with the stat demand or through court) so as long as the set aside application is put in tomorrow you should be ok and they would have to go through the small claims court (which they also can't do without the compliant agreement)....

    Do you know what the balance on the card was when you fell behind in payments?
    And do you have any other disputes on the card account ? PPI ?

      First class Recorded should get there just as fast and it's a few pounds less expensive, but it might not reach them until Tuesday or Wednesday and, given the circumstances, I'd say it's worth the extra money.

            I believe the last payment was made around July 2011 which left the balance as shown on the statutory demand. I have a letter from a debt recovery firm noting this payment but requesting further payments to them and not Lloyds TSB bank.
            I have no idea as to whether there was or was not any PPI on this card.

              Give Kate a call

              Otherwise we'll need to get this set aside application sorted out today, or an offer to pay by installments - as you aren't stat barred, don't have the CCA to fall back on as you have another 12 days before enforcement is barred, and the amounts are agreed with, you are looking at a negotiation unless Kate can see something in the paperwork to get around it.

                GR1159 is attending Court in person today.

                    Just to keep you posted. CCA sent as advised. Hadn't realised this but county court was by appointment only and I was requested to return next week. Something to bear in mind. Fortunately being Valentine's Day and me being a handsome chap, they squeezed me in and the papers were left at court against receipt. I could not have done this without all of your help. Kate is just amazing. Well you all are. :bounce:
