    Hi all,

    I'm a newbie here on this site who needs some urgent help.
    To cut a long story short, I was made redundant back in 2005 and had to take a much lower paid job, as a result of this I got into difficulties with my loans and credit cards.

    I had a Cahoot loan - application done online, cheque delivered by a postie, along with a signature.
    I stopped paying back in 2006 as I was unable to meet the minimum payments - I'm still on a lower salary now. The debt has been passed back and forth until it hit Capquest.
    The debt is for approx £4500, Capquest sent me a Statutory Demand through the post - no date stamp on the envelope, we weren't even in when it came.

    I sent Capquest a CCA back in 2009 - and they have to date sent nothing though - account is in dispute (I have proof of delivery and signature)
    I also am in negative equity on my house as I have 2 CCJ's.
    I have a number of other creditors.
    I cannot get hold of the mystical Barry Davies who is named on the SD
    The SD was not served in the correct manner - shout it have been hand delivered.
    Capquest have been told off before for attempting to use the judicial system to get people to pay up on consumer debt.
    My wife is also disabled and we have made a number of improvements to the house that aid her in her everyday life.

    Are these valid reasons for having the SD set aside?
