  • Bankruptcy problem

    My wife received a letter today from the courts. She missed her date last week regarding a bankruptcy hearing. Is there anything that can be done regarding this or don't we have a leg to stand on???

    Basically whats happened is that she had a catalogue a couple of years ago and we were paying it off up until I lost my job 2008. We had a real bad time, but have eventually come through it all managing to keep our house... just! Anyway one of the things that got put on the back burner was this catalogue. It got sold on to Lowells, they started to pester her last year and we tried in vain to get them to allow us to pay only a £1/mth till we got back onto our feet. Suprise, they didn't want to know. Earlier this year she received a letter from some solicitors telling her that she has to pay in full. In May she then got a letter informing her that she was to be served with a Statutory demand. They reckon they had already attended the house before. Anyway on the date I was in and no-one called! Next in August we had another letter from the same place stating they were going to start a bankruptcy petition and again they wanted to attend the house. Well, again we were both in, but this time someone did call. She handed me a petition which gave us a date. My wife has been suffering from depression this year due to all the crap we've been going through, it's no excuse of us both but she forgot to attend this court date.

    What I want to know is can they actually make her bankrupt even though we haven't received this statutory demand? We're both craping ourselves due to the fact that we may now end up losing the house, even though my wife only has this and an overdraft on her own bank account. No other major debts...
