  • Removal of Name from The Edinburgh Gazette after Trustdeed ends?

    I am scottish and was in a trustdeed from 2006 - 2009, I was fully discharged as was my trustee in 2010. When I signed my trustdeed it was published in the Edinburgh Gazette which is now avaliable online which anyone can access. I did not understand this was the case when I signed this in 2006 and I believe that in 2014 they no longer published trustdeed names in the gazette but mine will remain there forever unless I can meet there conditions for having it removed which would mean involving the police or a medical professional to give evidence.

    I personally feel it is unfair that my name and trustdeed remain a public record for something that happened to me when I was very young and involved just a few thousand pounds. I completed my trustdeed successfully and I haven't been in a penny of debt or had any financial problems since I signed the trustdeed. I looked and even many criminal convictions will drop off your record after 11 years so I feel it is unreasonable that this is still haunting me.

    I wondered if it is possible to somehow challenge the publication of my name and details on the gazette website under the new data protection laws (GDPR)? If anyone has any advice for me on this I would be very grateful.

    Trust Deeds are, I am sure, uniquely Scottish so there might not be too many people on here who can point you in the right direction. What about the solicitor your set the Deed up with? Can he/she not help?
