I was wondering whether anyone could help?
I got stopped by the police for overloading my van. Got taken to a weighbridge and it was confirmed.
I have no issues with the fines (Other than it seems a tad ridiculous given the nature of the "crime"), and accordingly don't dispute them. At the time of receiving the fines in the post, I had just come out off hospital. I was in there for 5 weeks, and during this time my business had accrued a mass of debt. I wasn't able to afford the 2 fines of £300, and accordingly the cheque I sent bounced.
They assumed that I didn't want to pay, and a court hearing was made, which ruled guilty in my absence.
The courts obtained an attachment of earnings, which suited me as I have been doing temporary work, and can't commit to a fixed amount each week.
Now the part that has confused me.
I got home from work today to a letter from Marstons, saying that they are enforcing the debt, and accordingly have now charged me further costs for something which I already had an arrangement too pay (AOE)?
Can they do this? What steps should I take?
Quite frankly, I don't have any assets as I've sold what I did have to cover other debts, and I don't have any money as I'm only just managing to pay my rent at the moment. Is there actually much they can do?
