    Hello,

    I was wondering whether anyone could help?

    I got stopped by the police for overloading my van. Got taken to a weighbridge and it was confirmed.

    I have no issues with the fines (Other than it seems a tad ridiculous given the nature of the "crime"), and accordingly don't dispute them. At the time of receiving the fines in the post, I had just come out off hospital. I was in there for 5 weeks, and during this time my business had accrued a mass of debt. I wasn't able to afford the 2 fines of £300, and accordingly the cheque I sent bounced.

    They assumed that I didn't want to pay, and a court hearing was made, which ruled guilty in my absence.

    The courts obtained an attachment of earnings, which suited me as I have been doing temporary work, and can't commit to a fixed amount each week.

    Now the part that has confused me.

    I got home from work today to a letter from Marstons, saying that they are enforcing the debt, and accordingly have now charged me further costs for something which I already had an arrangement too pay (AOE)?

    Can they do this? What steps should I take?

    Quite frankly, I don't have any assets as I've sold what I did have to cover other debts, and I don't have any money as I'm only just managing to pay my rent at the moment. Is there actually much they can do?

    Was the AOE with the court or Marstons? If your earnings are sporadic there might not have been enoughin the bank to take, so the attachment fails, and Marstons then move in to enforce. You could ask tospeak to the Welfare Dept at marstons to discuss options and highlight your health and other issues.

      If you are self-employed then they cannot have an Attachment of Earnings.

        The AOE was given by the courts.

        At the time I was doing the odd days work with a job agency, and they had me on their books. The letter from the courts stated that they would contact them for an attachment.

        My health is all ok now, so no need to contact the welfare team .
