Jacobs clamped my car refused to make payment arrangement

Hi all, so long story short my husband had s breakdown last year, we received a baliff demand 2013 for a parking ticket we knew nothing about, this was appealed and had no further contact until last night, we recieved a hand delivered letter from Jacobs stating that had taken position of my car and demanded £392. Original fine £82.
I do not believe we have relieved contact since the appeal however both the council and kabobs report they have wrote to the address over the past few months. My husband admits to not opening some mail but defiantly not receiving any recorded delivery mail.
Jacobs returned today and clamped the car. I applied for an out of time declaration which has stopped further proceedings but I had to pay the bailiff to remove the clamp from my car so I could go to work. Can they do this even when a hold on proceedings is in place, I attempted to negotiate with him but he just stated since he did a walking possession the previous day he could still take the car and would not remove the clamp without full payment.

Is there anything I can do to recover any money or do I just need to wait for the outcome of the appeal.
He also scratched my window removing his notice along with littering on the road when he scrapped it off.

Notifications of this type are only sent by ordinary 1st or 2nd class post. You would need to contact the Council to see what happened re your initial appeal - I would suspect they will say they never received it. If the vehicle was already clamped when you submitted the OOT then unfortunately it can be left in this manner pending a decision.

Before the Bailiff attended did you receive a Notice of Enforcement first? Have you asked what fees have been applied?

Hi, I applied for the OOT at 11am he clamped at at 15:30 but apparently they do not get updates until after 4pm. I did not receive any letters but they are adamant they sent a letter in July.
They have applied a £75 enforcement fee then £235 bailiff fee.

Most Council will not inform you that your appeal had been rejected . . . . especially if you sent the letter NOT recorded delivery.

IF the Council told the baliff that the warrant was put on hold for further investigation, then the bailiff should have removed the clamp.

You need to write (and send recorded delivery) a letter to the Enforcement Agency and ask for your money back, follow it bu, 48 hours later, as long as you can see that the letter was received, with a phone call. If possible record the conversationm but do tell them that you are doing so.

The Bailiff did not scratch the window and did not cause litter, as these action were done by whoever removed the stickers.
