    Today I received a visit from a Horrible woman from Ross and Roberts about outstanding council tax with Birmingham city council.

    I did have a payment arrangement set up with Ross and Roberts which I had been paying for the roughly the last 6 months but with receiving the current years water and council tax bills I missed Aprils payment. I was hoping to pay make two months payment later this month to catch up but they have sent out the bailiffs.

    My 6 month baby (Hasn't been well last couple of days) was sleeping when the agent came and starting banging on the door. I wasn't going to open the door but unfortunately she claimed she saw me through the letter box and she started shouting and banging louder and I was worried she would break the glass on the door. She shouted either I open the door or she would come in with the police and a Locksmith.

    I asked her if we could speak outside or in her van and that I know she can't force entry as she hasn't been inside my house before for this debt. She said she was willing to talk outside but insisted she had a right to gain entry with a Locksmith with the police in attendance. She then went and set in her van we talked through the window.

    As I was willing to pay the two months installments I asked her how much was the minimum she was willing to accept to which she replied £500 and she telephoned someone for call for a removal van and told me I had 30 minutes to find a way to make a payment. otherwise she was going to add charges for the removal van.

    I told her let me call someone to see if I could raise the money but knowing I wouldn't be able to raise that much today I called payplan to clarify if she could gain access (Wasn't sure if the law had changed last year). When she realized who I was talking to she said I now only had 10/15 minutes to make payment and started to call (she claimed) the police and locksmith and shut the window on me. This shook me up but luckily I still had payplan on the phone who reassured me she couldn't get into the house and police wouldn't do anything unless their was a breach of peace.

    After 15 minutes the bailiff banged on the door and asked if I was "Going to pay" and I replied I can't she said I 5 minutes before the removal van arrived. As she walked off the drive she pointed to the neighbors car and asked if that was my car, I told it was the neighbors. She realised where I worked (I was wearing my uniform as I was getting ready to go to work) and checked the car for signs it may be mine. She then went to my other neighbors house and knocked on their door. I told she has no right to discuss my situation with them due to Data Protection Act but she told me to shut up and stepped into the neighbors house. While she was in There I left my wife and baby home and locked the door went to move my car (parked at end of road) to somewhere else in case the neighbors tell which is my car.

    On my way back home I phoned Ross and Roberts office and asked to complain about their agent but was told I had to complain in writing. I told them their agent was threatening to break in and was also discussing my case with other people and asked them to call her and tell her to stop but they claimed the couldn't.

    On returning home I informed the bailiff that I spoke to Ross and Roberts and event they said agent couldn't gain access without a warrant and that I had a right to see the warrant but she just laughed and the office would just have sent me back to her.

    Couple of minutes later she drove off.

    I was wondering if someone could advise if the bailiff had a right to talk to my neighbors as I believe I should have been protected by Data Protection Act.

    Also does anyone have the email address to who I could complain to, in order to get her to back off as I'm worried she may return and harass my wife and children when I'm not at home. I already had to phone in sick as I got late for work dealing with her. (I think I have seen email address of someone at Birmingham city council on the forum before but cant seem to find it today)

    Any sample letters/emails I could send would be greatly appreciated, as would any other advice.

    You could put in a complaint using their online form in the link above, or email them/send a letter to the addresses I've quoted. I'm sure she has at least broken the DPA if she has spoken to your neighbours about your debt, but there are other Beagles more able to advise on that aspect than myself ... I'm sure they'll be along soon

      You say that you had a payment arrangement in place with Ross & Roberts. Was the agreement set up over the phone or in response to the Notice of Enforcement or had it been set up following a visit?

      Do you know what charges have been applied to your account?

      With council tax, if the bailiff has not previously been into your home and 'taken control of goods' the legal position is that they cannot force entry and the bailiff should know this perfectly well. Given the seriousness of this matter you really must ensure that any complaint you make is copied to Birminham City Council.

      I am confused as to the reason why the bailiff would go to the next door neighbour? There is always the possibility that the neighbour also had a problem with Ross & Roberts and had a debt with them as well? Bailiffs do have set areas of the city that they would visit on certain dates. As I say...this is a possibility. Have you spoken to your neighbour?

          Previous arrangement was set up over the telephone so they have not been inside my house. I had offered a lower amount (£50) knowing It might be a struggle when this years bills come but the they insisted on £100.

          She only decided to knock neighbors door when I told the car she asked about wasn't mine. According to the neighbor she told them she was a enforcement and wanted to know what car I owned.

          Any advice what to write in the complaint letter/email ?

            The bailiff is entitled to make discreet enquiries with neighbours.

            I wouldn't recommend complaining as you have no evidence of anything and will never be able to prove it.

            Keep your car well away for the short term, until this mess is sorted out.

            Write to the revenues dept of BCC and advise that you have run into cash flow problems and have missed a payment. You would like to re-set the arrangement up but R&R are refusing. Ask the council to now intervene as you do not have the funds to pay this debt in full. You are not trying to avoid payment, you are simply struggling financially and finding it difficult to meet these payments, along with other bills, including this current years tax.

            How much were you paying? What fees have you been charged by R&R?

              From the letter she stuck through the letterbox the charges are only £75 Compliance fee and £235 added to one debt of 487.71 and the letter also has the reference number to the second debt.

              Before I made the Payment arrangement the Debt amounts (from looking at old letters) of debt 1 - £487.71 + Debt 2 - £1071.57 but I have not seen a breakdown of the charges from what I can remember.

              I was paying £100 and asked for the payment to go towards both debts but the letter from today only states the original amount from the one of the debts (£487.71) but I think the total outstanding includes both debts as she has wrote £1519

              I should hopefully be doing a income/expenditure form tomorrow with payplan which hopefully I can send to the council to attempt to get reasonable payment arrangement from them.

                Get payplan to calculate how much you would have been paying under an attachment of earnings order. If it is less than what you have been paying, demand that you be permitted to pay the lesser amount. Remind the council that bailiffs should not force debtors into punitive repayment plans. Part of the reason that the £235 fee is so high is because it is meant to allow the bailiff time to sit down with the debtor and work out an affordable way to resolve the matter in hand. It is not in place for the bailiff to simply demand £500 "or else".

                  Down load a recoridng app to your mobile and record all the conversations with Ross and Robbers . If she calls again use your mobile to film the entire incident and if your wife has a phone ask her to film at the same time . Copy the movies to your laptop and backup to CD. Communicate with the council and record the calls . If they are anything like cambridge ciity they lie as a matter of policy. So by te way do Enforcemnt Agents. The reason for the backup is to prevent it being lost and to supply a copyto Ross and Robers if necessary . If you are in the street then you have right to film and as it is a public place people should have a reasonable expectationof being filmed.
