  • Letter of Enforcement

Hi, I received a letter 2 weeks ago from Rossendales it was an enforcement letter which they have charged me £75 for. It was relating to an unpaid council tax bill from a previous address. I have written to the council explaining that I have rent arrears and council tax arrears with my new council and enclosed photocopies of the arrears and my jsa. I also asked them to take the debt back and wrote to Rossendales to explain the situation too. Today I have received another threatening letter from Rossendales saying if I dont contact them they will be calling out and charing me another £250. The letter states that I have to deal with them directly and not the council and have enclosed an income and expenditure form. Last week I started to pay the council direct and now I'm confused...who should I pay? Should I send this form back to Rossendales or carry on paying the council? I haven't received anything back from the council regarding my letter.

    Re: Letter of Enforcement

Update: I received another 'reminder' notice on Thursday dated 2/3/15 saying if I didn't contact the bailiffs directly to arrange payment then an enforcement agent would call out and charge another £250. The letter stated in bold that I must deal with them directly and NOT the council. I spent yesterday morning at my local CAB office only to be told they couldn't phone either the council or the bailiffs on my behalf as the charge was for council tax from another borough and they can only deal with local councils and bailiffs from the borough I'm living in now! What's more annoying is I wasn't even living in the property the bill is for as my house was going through repossession with the mortgage company. Looks like I'm going to have to keep my doors and windows locked for a while and batten down the hatches.....Grrrrrrrrr

Repossession? Is there a mortgage shortfall? What is the bigger picture about your finances? There is no point is spending a lot of effort dealing with individual debts if your whole debt position is untenable.

Hi Debt Camel, yes there was a mortgage shortfall of £10,000, in all honesty I'm in an absolute mess and don't know how to get out of it. My main concern at this moment in time though is trying to keep the bailiffs at bay for this council tax. I have another appointment on Monday at my local CAB to discuss my finances...or lack of them and was hoping that maybe a call from the CAB would have given me a bit more time. I was looking at trying to go bankrupt but I need £700 in order to do it, oh the irony.

How large are your total debts? If they are less than £15,000, a Debt Relief Order is much cheaper and simpler than bankruptcy - see http://debtcamel.co.uk/debt-options/dro/.

The DRO limit is going up to £20,000 in October. Battening down the hatches until then may be your best option!

If your debts are over £20,000 then you need to be very clear at CAB that you want them to help you apply for help with the bankruptcy fees. As you are on JSA you will get remission of the court fees so it's "only" the £525 fees you have to raise. There may be local charities that can help with this, or ones connected with your past career, or the big utility trust funds may help.

Thank you so much for that piece of information Camel, I didn't know this and if I can hold back until October then I should be able to go for the DRO instead. I have a recent credit report from Experian and will take another good look at it the double check but I'm sure it will be just under the £20,000. Maybe, just maybe there may be some light at the end of tunnel! Thank you again, I'll check back in once I reread through my credit report properly.
