Have requested the SAR from the Bailiffs. Have asked them to supply all documentation relating to this matter and the registration of the car they levied.

When I told the Director of Finance that this was a false levy he said that as a 'Gesture of Goodwill' the Bailiffs had removed the £235 fee - odd don't you think ?

I received a call from the Bailiffs last night (abt 8pm) asking (well demanding) the balance and if I would not pay then they would enforce the order.

So here are my questions for you to think about.

Can they actually come to my house now and levy anything ?
If they removed the enforcement fee does that mean they can enforce again ?
Just because they removed the fee, does this mean the original levy was false ? I don't think Bailiffs like giving any money back.
When should the Council take this back from the Bailiffs ? I have requested this but the Council have not responded.

So, now it's a case of lock all my doors etc., hide the car - what a nightmare. Glad I've got you people helping me out though - can get to you after a while, all the lies etc.,

just make sure you do the other letters as well, offical complaint to baillif agency and council. Make sure you make the offers to clear.

So here are my questions for you to think about.

Can they actually come to my house now and levy anything ? Yes the liability order is still in affect and no arraingment to pay has been acsepted
If they removed the enforcement fee does that mean they can enforce again ? Yes they can still enforce
Just because they removed the fee, does this mean the original levy was false ? I don't think Bailiffs like giving any money back. Possibly, but you need to prove it
When should the Council take this back from the Bailiffs ? I have requested this but the Council have not responded They dont have to, but i suspect they will acsept you offer of payment.

Just so you understand

The advise i gave you ( complaint to baillifs, then council, an d do a SRA ), allows you to take it further if your not satisfied. Your expected to get through both complaints procedures before you make a complaint to the regulators.

You have done this now, both the council, and bailiffs, usually rely on people just arguing back, instead of following the correct procedure through there systems.

At least they can't come in through the windows now (and you can refuse them entry :nod
If you park your car away from your house, and keep the door locked/on a chain then there's not much they can do about getting in

After the phone call last night - sent an e-mail to the Director of Finance at the Council telling him he should not harass me via his agents (was strongly worded I must agree), anyway after not replying to me after 6 e-mails he sent this almost immediately, despite saying this was his last response 4 e-mails ago :



I am replying to your emails of the 17 November 2014. As I said in my last response, I have completed my investigation into your complaint and am going to take no further action. In view of this the suspension on recovery action that was placed on your case has now been lifted.

The information that you are requesting would be available from the Bailiffs and it would be better for you to talk to them and work with them to resolve this issue. I have checked into the issue of the levy on a car and can tell you that the process of obtaining a levy was suspended due to the change in regulations concerning levies and therefore there is no levy on a car on your file.


Please note that in accordance with my earlier emails, we have completed the investigation into your complaint and will not respond to any further correspondence on this matter. I have highlighted that you do have the option to make a complaint to the Local Government Ombudsman or make a complaint to the Bailiffs directly.

I have taken out the name of the company and put in the word Bailiffs - should I ? I can let you know if it helps you.

So, what are these new regulations concerning a levy that he tells me about. He never mentioned this before and only after my e-mail last night comes back with this.

I don't see how they can levy on a fictitious car and then say oh...sorry it's all to do with the regulations.

So, there is no levy on this car on my file with the Council or Bailiffs. That gives them 'carte blanche' to do what they want. Not so ?


What do you think ? Was there a change in regulations ?


In addition,

Due to the gravity of the situation I have made a formal report of attempted fraud by the bailiffs and council to the City Of London Police who should be in contact with me shortly. I have also made mention that I believe the scale of this fraud is very extensive and not an isolated incident. This "collections" agency and others like them may be involved in defrauding millions of pounds from people. Will update on the police investigation.

The word "levy" was replaced with "controlled goods agreement", like a bailiff is now an enforcement agent. It makes no difference and a levy made before the new regs certainly wouldn't become invalid. You're being lied to again and tbh, it's disgraceful. Include this lying fool in any complaints you make.

So, if there is no controlled goods agreement, there is nothing they can do. Due to their lies and duplicity, tell them to shove it and refuse point blank to deal with the bailiffs.

You've heard this before but, this whole matter is full of lies - should I just pay the £248.00 (less the phantom visits) and fight it after - I can pay this if you advise me to.

I think the Council and the Bailiffs have lied throughout. The Finance Director has quite possible dug himself into a hole defending these people he employs. He should think about 'What a tangled web we weave when first we venture to deceive'

yes, but they was just trying it on with the car, Give them a few days to digest your complaint, see how that goes.

You could take this further, but you need a lot of spare time to do it. Firslty try get the charges dropped and payment arraingment made, then decide if you want to take it further

Well they digested my complaint.

Just got a reply from the Council, saying they are taking this back from the Bailiffs and an offer to pay them direct.

I wanted confirmation that the EO's would not come to my house (well..they never have so no problem so far) and that this will be less the fictitious charges for visits that the Bailiffs made.

I made it clear that the Bailiffs are fraudsters and that I had made a report to the Police and that I now have a Crime Number against the Bailiffs and the Council. I pointed out that the Bailiffs had a levy against car that was basically 'fraudulent' and that the Council had agreed with them - leaving me to defend myself continually against these charges.

It's terribly funny that the only reason I stopped paying the Bailiffs is because I thought the amount they were asking was less than I owed ! I would never have known what liars and fraudsters the LO's (Bailiffs and Council are had I not said that I think I owe you more.

What terrible little liars they all are - know they are caught - but still want the money

So, at least I can now pay the Council direct.

I do have the time to take this further and I will do - have a Crime Number now regarding the Bailiffs and Council.

Only problem is, do you think the Bailiffs will take this personally ?? very worried now as to what they might do - still keeping all my doors locked - they know my address - should I be concerned - I am.

For a person holding public office, which would include a local authority employee, knowing that wrongdoing is going on, failing to do anything about it and then covering it up is, at the very least, Misfeasance in Public Office. If it is something as serious as fraud, then it may be the more serious matter of Misconduct in Public Office.

I am providing a link to the website of the Institute of Revenues, Rating and Valuation (IRRV) to which a large number of local authority staff working in Revenues hold membership. Check the person is a member. If they are, consider making a complaint. Professional institutes do not take kindly to members bringing their name into disrepute.

Glad you stepped in here Bluebottle.

Very interesting this Misfeasance in Public Office, never heard of it. Just looked it up and it fits very well with what this person has done.

He was quite happy for me to be charged £235 for a 'levy' that was never done and charges for visits that, again, were fictitious. He confirmed that all these charges were legal, despite numerous e-mails from me. Even after I said that the 'levy' was on a fictitious car and the EOs never visited, he insisted that it was true.

As I posted before, the Director of Finance told me that this 'levy' on this car has now been removed from my file. Can the EOs remove this from their file, so this dishonest act never happened ?

Looked up the Institute of Revenue but the Director of Finance I have dealt with is not listed.

What annoys me most is that the only reason I wrote to the EOs was because I thought I owed them more (given the telephone payment balance, the balance was always a few hundred pounds lower than the amount stated on the letter they sent (the only communication I have ever received from them), I had no idea whatsoever that they had added their £235 to the total for the Google car, only knew about it after the Director of Finance told me about it !

As I posted before, I have reported the Bailiffs and the Director of Finance to the Police for Fraud (section 2 Fraud Act 2006).

I will be taking your advice re Misfeasance in Public Office further as it seems to fit in with my complaint.
