  • Jacobs threatening of removal of my motorcycle

    Hello,
    I'm desperately seeking advice as a Jacobs bailiff turned up today seeking the full payment of a council tax bill.
    Yesterday he posted a letter through the door which gave us 24 hours to pay. (the problem being was that my wife hadn't told me about the debt or the previous letters from the company)
    The agent then stated he want full payment today which i replied i could not do. He then said he was going to remove mine and my wife's motorcycles from the garden.
    He then left.
    I phoned him at 5pm after trying to sort of my finances to offer a debt repayment but he was having none of it, just said its too late, they are going to remove the bikes and that they have a court order to do so.
    Ive seen no order from any court, the bikes are now inside the house and there is no way im allowing anyone through the door.
    What the hell do I do?

    Hi postiegaz welcome to Legal Beagles

    Has he given you and have you signed a "Controlled Goods Agreement listing the motorcycles, and has he pushed anything through the letterbox listing them?
    This is important,

    Have you made any offer of payment that was refused by the bailiff, and do you have a car? He cannot force entry at this point either, and you aren't telling him the bikes are in the house, they could have been taken away by an itinerant scrap forager, like what happens to wheel clamps sometimes.

    Might be worth contacting the council to ask

    !: How many Liability Orders they have for you?
    2: When were they obtained?
    3: Hoow much is owing on each one?
    4: When were they passed to Snacobs for enforcement?
    You should compile an Income and Expenditure list to back up any offer you make, as Jacobs are notorious for demanding payments that a debtor cannot afford or keep up. This however leaves them open to a Formal Complaint down the line.
