    Not sure if this is the right thread

    A few years back the local council was using the Elvis scheme to steal untaxed but legaly parked vehicles (sorned off road and parked off road).

    i helped a friend who had his car taken from his drive , the council claimed the drive belonged to them , the deeds showed otherwise.

    when they grudgingly brought the car back they were asked why the hadn't removed the vehicle across the road , on a council owned property.

    the reply was that because the car was covered by a tarpaulin they were not allowed to remove the tarpaulin to check the details etc.

    Is this right???

    A bailiff attending your property for council tax can't force entry (with out control of goods) , they can't break into sheds , garages etc.
    but what about a car on the drive covered with a car cover? are they allowed to tamper with it?

    if not is there a section of law they are breaking? is it civil or criminal?

    Is the Car being hidden from the Bailiff by the Debtor?

      The car in question is a company car , the debtor is a director of the company.

      The vehicle is on private land (drive) and is sorned off road. currently it is under a car cover to protect it from the weather. there is no need to hide it from the bailiff as it is owned and registered to the company.

      the company (LTD) shares the same address as the debtor

      To get the registration of the car and make / model they would have to remove the cover , is this illegal?
