    under the new regulations can bailiffs apply fee's to cases they have already dealt with?

    Example Bailiff A gets the instruction from the council
    they apply the £75 fee
    attend premises and apply the £235 fee
    attend a further 4 times and give up.

    Example Bailiff B now gets the instruction from the council
    they apply the £75 fee
    attend premises and apply the £235 fee
    attend a further 4 times and give up.

    Bailiff A is now given the same instruction again. Can they apply the fee's????

    Good question

    When a debtor receives a Notice of enforcement, the debtors goods are bound for a period of 12 months from the date of that notice. At least within that 12 month period, no other company can become involved as all of the debtors goods are already bound by the first notice.

    In the case of council tax, the council will almost certainly move on to another means of recovery. In your scenario though, if the first set of bailiffs have given up then their fees will not have been paid. Effectively, the creditor could go through every bailiff company in the country and no fees would have been paid.

    Bailiff A would not be able to apply fees a second time & in any case, in order to arrive at this situation, we would be more than 2 years down the line.
