  • Whyte & Co

Hi all i am new to this forum Today my wife received two letters regarding Pcn tickets below i have put what the letter said
Firstly here is the letter that i received which is from WHYTE & CO (debt recovery & legal services) dated 15/may 2014

    Dear sir madam,
A PCN has been passed to this office for collection in respect of contravention as detailed below
TAKE FORMAL NOTICE that unless the amounts specified are paid to this office IN FULL within FIVE DAYS from the date hereof recovery action will be instigated.
Then it says Vehicle details,Alleged contravention
    date of contravention 23/06/2012
then says all debt must be paid direct to whyte &co and not to thurrock council

The second letter is exactly the same but date of contravention 03/01/2012
I called the council and they said
Right here is what council said verbally on phone
They said they can see on there system that one of PCN was paid by cheque but this had been returned to them in a damged post office bag and they said that they had wrote to me regarding this which again i never received .The other PCN also never received any correspondence about this ,i cant believe that a council would wait that long before chasing up payment i think they have made a mistake .They also said i had to prove if i had paid or appealed a being such a long time ago i have nothing to prove this so its their word against mine .sorry to be long winded .Thank you

      Re: Whyte & Co

Are both letters entitled: Notice of Enforcement?

What is the date on each letter?

What date does it state that payment is to be made by?

Can you post back with the exact charges on each letter.

Lastly, do you known whether the letters were sent by first class? If sent by Royal Mail is there a code number on the envelope?

Lastly, have you checked with the council for confirmation of the precise address that they have on their records (if there is an error this could explain why you had not received the notices from the council.

          Hi thanks for reply
No none of the letter state notice of enforcment
Both letter date 15 may 2014 and said they want payment within five days which makes that the 20 may 2014 so five days are up already.
Charges are £105.00 for each Pcn one date from 1/1/2012 and one date 23/6/2012
I dont know but presume letters were sent first class .
Also council does have correct address but i have had several different postman over the last few years so could have easily been mis-delivered.
Just think whyte & co my be trying it on as i am worried and you know some people will just pay but i have lived in the same house for 17 years and have had pcn before (as i live in a permit only street) and they never ever left it 2/3 years .I just cant believe after all this time having not heard a thing to now sort of being threatened to pay in CAPITAIL LETTERS within five days.Any advice would be gratefully received thanks for your time

If you think the PCNs are your fault I would pay
The Black rat (Rattus rattus) is a common (hence the accusation of being Pleb) long-tailed rodent of the genus Rattus (rats) in the subfamily Murinae (murine rodents). The species originated in tropical Asia and spread through the Near East in Roman times (another thing that we ought to thanks the Romans for, besides roads, aqueducts and public toilets) before reaching Europe by the 1st century and spreading with Europeans across the world.

A mutation of the beast now comes black leather clad, riding a motorcycle that looks like a battenbergh cake on wheels.

A skilled predator, totally ruthless with it's prey, but also known to be extremely generous in doling out tickes that can provide points for motorists who want to downsize from mechanically propelled vehicles to bycicles.

It's a dirty job, but someone got to do it!
