    Conflicting information lol

    I have just called the court to ask about the BOS and I have to write in to do it and costs £45, so will get on that in a moment!

    I'm not hearing anything from DG or Varooma, so my assumption is that they are trying to find the vehicle? Or discussing my proposal of £120 a month?? I've no idea as they have stopped communicating!

    Surely irrespective of weather things are legit, over £1000 in fines which was 1 visit, no other letters, calls or anything, is not right though?

      I understand fully, I didn't pay the £179 in due course, so I will be peanalised for it, but £1108????? seriously???

        I would get the complaint in asap. It looks good btw. It is clear in the letter exactly what you are complaining about. If anything comes of the BOS, you can address that further down the line.

        Delaying could result in further fees, further visits & further hassle.

          Well I have put the complaint in, as I feel I have to do SOMETHING, can't just sit about and wait for the BOS answer, and I am living in fear of the knock on the door at the moment, so had to do something to try to help. It may not, but worth a try

            Hove you requested a copy of the BOS form the creditor ? If you can get the number the costs are significantly reduced for the search.

                1. Recovery action should be suspended while the complaint is investigated. This relieves the OP of the stress of not knowing if & when she is going to receive a visit from 2 thugs.

                2. No more pressure will be placed on the OP to enter into punitive repayment plans that she cannot afford.

                3. The ball has started rolling into getting these obscene charges reduced.

                4. The new owners of the vehicle are not going to have the car taken from them while the complaint is under investigation.

                5. Ultimately the complaint will mean that the OP is able to make sensible repayments that she can afford which in turn means the vehicle is not under threat of removal

                    Excessive, unfair or unlawful charges by lenders is something the FCA takes seriously. When it was the FSA, it fined Redstone Mortgages £630,000 for doing that, amongst other things. The FSA was going to fine Redstone £900,000, but Redstone co-operated with the investigation and got 30% discount. Pity.

                      In the OPs case it would IMO be better to find out if they have any right to be pursuing the debt in the first place.
                      If there is no BOS they do not, irrespective of any other entitlement, without a court order.

                        The FCA do not investigate individual complaints. This remit is still with the FOS.

                        In the real world, if the FOS investigate a complaint, it will cost the DCA circa £500 for the investigation. As thick as dg probably are, the thought of having to pay for an investigation by the FOS, coupled with any findings made, are more than enough to compel them to place recovery on hold, agree a sensible repayment plan with the OP & review their obscene charges.

                          Theses evens will be a distant memory by the time the FOS does anything, the OP needs to put them to proof that they have any right to be perusing her.

                          I personally have had a successful complaint logged with them since 2011, also they usually do not enforce, they "mediate". They also require that any complaint be made to the other party before they intervene.

                            So when we get details of the BOS, we can do exactly that. Untill that time, it is far better to be pro-active than to bury our heads in the sand and hope that everything will be ok. Regarding complaining before they intervene, what do you think the OP has done this morning?

                            You made a very good point regarding the BOS but to advise to sit back and wait in the hope that something will come of this is not so good. Wheels are now in motion and the OP is far better protected now than she was prior to making the complaint. That my friend is the real world.

                              Agreed as to approaching the FOS. However, reporting this sort of thing to the Investigations Unit at the FCA is also advisable as they then have the lender on their radar.

                              The FOS is an arbitrator, whilst the FCA is the regulator. Trading Standards undertake investigations where asked by the FCA.

                              I agree with ST as to a pro-active approach.

                                Firstly, I am not your friend
                                ( i do not know you)

                                More importantly, if you are going to complain it is as well to know exactly what you are complaining about.

                                If they are seeking to recover a vehicle which is the subject of a BOS then they are entitled to charge recovery fees, if not , not.

                                Reporting them for doing something which they may be entitled to do is pointless.
