    What I would do is find out which court granted Mr Pen y Pidyn from Marstons his certificate, and write a letter to the District Judge there regarding his pressure for you to pay in spite of a Stat Dec being sworn, and ask whether it could be kept on file to await his certificates renewal, or whether a Form 4 would be appropriate, bearing in mind the bailiff has actively prevented you from working by seizing and refusing to return essential specialist tools. If Marstons are monitoring this thread, it would be in their interest to tell their numpty to give the tools back like right now, as if the DJ on receipt of the letter thinks the bailiff has seriously overstepped the mark he may remove or revoke the certificate forthwith without a Form 4 this putting the bailiff on JSA

      Bizzybob, as ever you are a fountain of food for thought & good advice. I'll await whatever phone calls come tomorrow,& if nothing is forthcoming, I'll have a session of finding out what certificate comes from where.

        The main thing is to avoid a Form 4 unless the DJ asks you to submit one as a result of any letter you send to the certificating court.

          Yeah, I've done googling on the subject. I didn't realise that it was such a heavyweight of a form complaint. Not something tobe taken lightly, but equally, I didn't tell Marstons I would be submitting one, just mentioned it in conversation. If I've heard nothing by tomorrow, I'll be finding out where the certificate was issued though, & firing off some letters.

            send the bailiff a text and ask him when and where he was certificated you might not receive a reply but hopefully it could give him a few sleepless nights especially if he knows you mentioned a form 4 to Marston's

              You should bear in mind there is an anomaly over Certificates for Bailiffs collecting on Court fines and that is the contract stipulates that a Bailiff doing such work must obtain a certificate within 6 months. It could be you have a new starter.

                Ah, well I never knew that Plodderton. That's worth remembering before I open a whole can of worms!! Wonder if he is a newbie. Would possibly explain his somewhat Gung Ho telephone manner!
