I think bluebottle meant ''Being late with a payment does NOT constitute grounds for committal to prison. Rossendales are misrepresenting their powers and the law and are sailing perilously close to the wind in the legal sense.''

Prison is for won't pays not can't pays.

        Amethyst,

Thank you for that, What you have posted is what I meant to say. I have corrected the typo error.

        Nicky,

Sorry for the typo error. Please let me assure you that, where Council Tax is concerned, only a local authority can apply to a court to commit someone to prison for non-payment of Council Tax, not some civil enforcement company that has an appalling record of misrepresentation of powers and allowing its bailiffs to act in ways that come close to, if not, actually breach the law.

If a civil enforcement company, like Rossendales, made representations to a local authority, claiming a debtor is actively avoiding payment, knowing those representations to be false and which leads or could lead to a debtor being committed to prison, the civil enforcement company could be in very serious trouble indeed.

As Amethyst has said, where Council Tax is concerned, committal to prison is for those who are determined not to pay whatever, not those, like yourself, who are struggling to pay.

          Hi thanx for that?
i owed 3 lots of council tax in the last 12 months I have payed rossendales a total of £1600 which as a result my other bills and mortgage are now in the red? I did it to keep them from taking my property?
I have expressed to them that I am willing to make monthly instalments, I offered to pay £200 and the rest at the end of this month, and they have refused? I have borrowed from family and got loans of loan sharks? I can't keep going the way I am? Is my best option to contact the council tax office

            Nicky,

I think it is best we take stock of the situation and decide what the next step is; could you answer the following questions, please?
            1. What is the total sum of Council Tax Arrears?
            2. How much has been paid to Rossendales in all? £1600
            3. How much of this figure consists of CT arrears?
            4. How much consists of bailiff fees?
            5. Who told you or coerced you into borrowing money from a loan shark?
            6. Did Rossendales give reasons for refusing to accept your offers of payment?

Once we have answers to these questions, things should become clearer.

Re: Rossendales. RE: council tax owed x2

The total amount left to pay is £650 for last year, ( which I am paying £150.00 a month)
and £650 and now bailiff costs because I failed to pay on Friday.
all £1600 has been payed and it is all council tax and I think 1 or 2 bailiff costs?
the loan shark was a desperate measure to pay bills and pay for Christmas for my son n daughter and it was solely my choice.
and they didn't give any reasons for refusing just that it had to be payed in full

                Nicky,

                £650 x 3 = £1950 - £1600 = £350 outstanding

Could you list the bailiff fees if you have a breakdown, please?

                  Nicky,
I know you're panicked and think (wrongly) that the bailiffs can chuck you in jail and raid your house but they CANNOT do anything like that.
What's happened is they know they have scared the living daylights out of you and are using that to force payments out of you....it's typical bullyboy behaviour (bastards that they are)
This is what we need you to do:-

Firstly,,get yourself a large cuppa,,sit down and relax....then try and type out the answers to all the questions you are being asked ^^^ up there. The devil is in the detail and I promise you noone is judging you or your actions,we all do rash things when we're panicked.
Rossendales are relying on you not realising what they are doing is sailing very close to the wind legally.
Everyone will do as much as they can for you on here but you must put down exactly what you're asked,,,it's really important.

I'm very tempted to advise you to tell the bailiff to go swivel. Go over his head to his bailiff manager or, better still, Rossendales' Customer Services Manager, and ask for a full breakdown of all transactions on the account. They are legally-obliged to provide you with a full breakdown.

                              1. Move your motor car (if you have one) to inside a garage and lock the doors securely. Otherwise, park it some distance away - in the secure compound of where it is serviced would be a good idea.
                              2. Lock the doors and windows.
                              3. Close the curtains; a constructive levy based on what he may espy through the windows would be irregular and invalid, but it could end up as your word against his. Besides, it's better not to tempt the oaf.
                              4. Open an upstairs window to tell the jerk that the motor car on which he claims to have levied distress really belongs to your neighbour / your doctor / your local priest / whomever, who will sue Dosserdales for its return.
                              5. Also tell him to take a 517m walk along Wigan Pier.

I have looked for the CEO of Wigan Metropolitan Borough Council, but http://www.ceoemail.com just has a name without an email address and the name may be out of date. Another site gave the name of Joyce Redfearn, but she quit as CEO on 11th January 2014.

I'll keep looking. Meanwhile, you can find your local elected councillors and MP at https://www.writetothem.com

Did the dossenfails grunt* turn up? If not stay in siege mode with the curtains closed, and car well away.
