  • Received bailiff letter for PCN I've already paid!

    Hello. I've just received a bailiffs letter for a PCN I received on 21st of May. I paid this and have a bank statement in front of me showing £55 paid to the borough for this.

    I have only parked in this borough once as I was using the tube from there. I checked on the parking appeals page and it takes 65 days and I must appeal in writing.

    I do not know whether I have received any other paperwork as I moved 6 months ago and only kept Royal Mail redirect for a month. But it is impossible for me to have received 2 tickets for the same offence!

    The he way things look I am going to have to pay this now whether I like it or not. My partner is away and I'm on my own with a toddler and an autistic child who gets upset by just normal door knocking!

    Is is there anything I can do? I will have to put this on my credit card and I can't really afford to do that!

    Hello Joy and welcome to the Forum.

    Reply to the Bailiff letter stating the facts and at the same time write to the Borough concerned and ask the question, copy the Bailiff and the Borough with the letter that you are sending to the other.

    Do not forget to post both 1st class recorded, check on line when it is being signed for, then when you know that the Borough has received it call them on the telephone, make sure you can quote when it was signed for and by whom, and ask them to halt the bailiff in it's tracks.

    I do not think you can be penalized twice for the same offence in the same place at the same time, unless some lowlife ripped the first ticket you were given off the windscreen and another parking attendant slapped you a second, then it's an issue to be taken out with the Borough again.

      The bailiffs are confero. Letter was sent 3rd of jab, received on the 6th. Says they have a warrant of execution and to pay the office within 7 days so by the 10th or to make goods available. My car is HP so should I assume they can't take that or move it elsewhere?

        Car should be safe on HP, but some bailiffs claim that they can still take the car, flog it and pay the finance off with the remainder of the proceeds, if a finance company allowed that they would be double losers.

        The sale would likely just cover the bailiff fees and a bit of the inflated (by the baailiff) debt

        They would be in breach of contract with their customer the debtor, and all installments made on the agreement would have to be repaid to the disgruntled former keeper.
