  • Council tax bill - Newlyn

    Good afternoon,

    It`s a blessing to have found your forum.

    I have read the golden rules and unconsciounsly applied them already. But ... still I am very concerned and scared.

    My story:

    Used to rent a house from an old customer, no contract, everything was paid cash in hand and I was drafting a few letters that the rent I am paying was covering for rent for the house, councilt tax and water bill.
    When I moved out old landlord asked me to write a letter that I moved out and at what date. Unfortunatelly I did not make a copy of that.

    Now I started receiving letters from Newlyn and Removal of Goods Notices at my new address. I am very scared.
    My sister lives home and 2 other ppl that I share the house with - they are all complaining and all are very scared.
    I have not received any invoices from Council for me to know what is it for. I called the old landlord he said that he was paying the council tax and also that he is being chased for the same amount of money.
    Landlord is now in Africa and asking me to wait for him before I take any measures against this.

    On one of the Bayliffes letter it was writting that they will send me to the Magistrate`s court or something similar that I cannot remember at the moment.
    The total sum they are claiming is £896.49

    I would appreciate any kind of advice , and I said I will first open a thread before I contact Council or the Bayliffes by myself.

    A very important question : if someone else opens the door for them - are they still allowed to make note of things that they believe to be mine ?

    Any help is greatly appreciated

    First rule of dealing with bailiffs - DO NOT OPEN THE DOOR TO THEM.
    Second rule of dealing with bailiffs - SAME AS THE FIRST RULE.
    Golden rule of dealing with bailiffs - REMEMBER AT ALL TIMES THAT BAILIFFS LIE.

    I'm not shouting by putting the above in upper case letters, simply emphasising the importance of heeding the rules.

    Do you know why Newlyns are sending you threatening letters? Is it to do with Council Tax at all?

      All letters have Council Tax circled with a pen - so it should be for council tax.

        The first thing you need to do is speak to the local authority whom Newlyns claim to be acting for and find out how, when and if they obtained a Liability Order. Once you have that information, you can then start pressing the local authority for answers. Be aware that the local authority may try the stock answer which is "You have to deal with the bailiff," which is total bovine excrement. There is nothing in law that requires you to deal with a bailiff and if the council fail or refuse to engage, they are being disingenuous to say the least. Which local authority is involved, please?

          Paperwork received shows local authority as Coventry City Council.

          I have now found out another outrageous thing - the house was a council house and the landlord should have never RENT that house. And he didn`t even bother to pay council tax. I CAN`T BELIEVE IT !!!

            There was a case involving Coventry City Council and Newlyns on this forum a few months ago.

            In your particular case, it has come to light that the landlord did not have planning permission to rent out the property to tenants, including yourself, and has not paid any Council Tax. This now brings into question the veracity and legality of the Liability Order. The onus is on Coventry City Council to show that you are the Liable Person, that is, you are legally-liable to pay Council Tax under the Council Tax (Administration and Enforcement) Regulations 1992.

            Newlyns have no lawful authority to take you to the Magistrates Court or threaten to take you to any Magistrates Court. Only a local authority has the power, in law, to do that.

            One question that Coventry City Council need to answer is why they are chasing you and the landlord for the same sum of money?

            Contact Coventry City Council and try and gets some straight answers from them. In the meantime, I would contact your ward councillor and also speak to CAB or a Law Centre, if there is one near to where you currently live.
