    I currently have a CCJ against me, for £5000 which I believe has been enforced. What does this mean?

    I have come home tonight to a letter through the door, telling me that my 2 vehicles have been levied in my absence, with a note, in the form of an A4 piece of paper warning me of this, on both my car which is on HP, and my van which I own outright.

    The letter informed me that I had 7 days to remove any personal effects from these, before they were removed.

    Is this all correct? Where do I stand? And what can I do to avoid it? I do not have £5000, although am happy to set up a payment plan.

    Please advise.......!!??

    Is the car on HP or did you buy it using a personal loan from the bank?

    If it is on HP this should appear on an HPI check, thus the car belongs to the finance company and can not be taken away.

    Is the van, which is finance clear, used exclusively in connection with your business/vocation? If the answer is yes, then it can not be taken either.

    How long have you been aware of this CCJ, and when it was imposed did you attend the Court Hearing?

    You might still be in time to apply for a delayed payment, but I am not so sure.

      Is this van used soley for work with you as the only driver? Could you do your job without it using a cycle or public transport? I ask this as the HCEO will argue that the van is fair game as you own it, and you can use public transport to get to jobs.
