  • Rundles Fees Problem

    One year ago a Bailiff turned up at on my door from Rundles demanding payment of around £5000 for an unpaid council debt from five years ago, there were three separate liability orders.
    The debt was from an address I shared with some friends, I managed to get the account put on hold by the council and proved successfully to the council that I was not liable for the whole bill because I only lived at the address for one year not the three years they were claiming.

    The council sent me a revised bill which I paid in full, they also sent me a statement of my account which clearly states my balance as zero.

    Two months after I paid this bill to the council, Rundles visited my house again claiming that I had not made any payments to them, this is correct because I paid the council direct as they sent me the revised bill. They made a phone call to the council and then stated that I only owed them £85 for fees.

    Today I received a threatening letter from Rundles stating that they will be removing goods from my property in the next few days. As far as I know they cannot remove goods for fees if this is the case how can they be allowed to send this letter to me?

    The letter also references a Liability order which has been closed by the council, would this not be classed as trying to obtain money by deception?

    I don't trust Rundles if I pay the £85 how do I know that they wont start chasing me for more money.

    Can anyone offer some advice on how to solve this problem.

    The most they are entitled to charge is £42.50. Bailiff fees for enforcing CT arrears are set by law under the Council Tax (Administration & Enforcement) Regulations 1992. Ask them how they get £85. Unless they have a valid and lawful levy, the most they are entitled to demand for two visits is £42.50 (1st visit @ £24.50; 2nd visit @ £18.00).

    Go into the Stickies section in the Bailiff Forum, click on the link for "Useful Letters" and then click on the link for "Breakdown of Fees Letter". Amend as necessary and sent to Rundles by Recorded Delivery. Rundles are obliged to provide you with a breakdown of fees at their expense.
