  • Phoenix Commercial Collections continued...

    phoenixletter.pdfHi all
Firstly, I apologise for continuing on from an existing thread with this new one. I wanted to add an attachment but couldnt do so for some reason.
Anyway here is a scan of the letter Phoenix sent me last week trying to justify their daylight robbery.

I just want to reiterate that they lied about seizing my wifes car & issueing any official paperwork. All they posted was a poor photocopy of 'Removal Notice' with a mobile number on it,no amounts of money stated . They also lied about having no record of a conversation with me. The total fee of £354 was paid by me using my wifes card.

    Thanks

Yep. Looks like a standard "We-couldn't-possibly-have-done-anything-wrong" letter. I would be inclined to put Phoenix to strict proof. This means that they must produce hard evidence to substantiate any claims they are making. If this were to go to the extent of you issuing a small claim against them in the County Court, failure to disclose on their part would not do their case any favours.

Have you considered making a complaint to Eric Pickles, Secretary of State for Communities and Local Government, through your MP? It is Eric Pickles who brought in the new guidelines for local authorities using private sector bailiffs to collected unpaid CT and PCNs. I do not feel Mr Pickles would be too enamoured to learn that local authorities were ignoring the guidelines and letting private sector bailiff companies carry on as before.
Life is a journey on which we all travel, sometimes together, but never alone.
