  • Marston Fees

    Hi all

I have been appealing against a PCN recently that was declined and after numerous telephone conversations, emails and letters between myself and TFL they passed it over to Marston to retrieve the money owed. Whilst the case was over with Marston I was still speaking with TFL, and by the time I had finished correspondence with them I had bailiffs at my door.
I had advised them TFL were still cooperating with me but this ment nothing to them and I had a £187 debt to TFL, and Marston were demanding £275 in fees. I agreed to pay the debt to Marston but not the fees as I could not afford them. As I work a 0 hour temporary contract I do not have permeant weekly work so some weeks have no income, I decided I would pay £5 a week + a £1 debit cars handling fee each week until I had work a full week were I could afford the fees. 2 weeks later I have received another bailiff letter advised that the outstanding balance is £550! That's just Marston fees!

Like I said I have paid the original debt in full and made 3 payments weekly to start paying the bailiffs there fees but there still knocking at my door demanding more money. Where can I go from here as there I no way I can afford that! They are clearly refusing my weekly payments as they are too small but this is all I can afford until I have more work! At least I'm making a payment right?

Better sent initially by email followed by a copy in the post to Marstons.

            Re: Marston Fees

I earlier suggested that the OP should write to Boris Johnson, as part of his role is to oversee TFL (link) and it seemed that the case was sent to Marstons rather sooner than it should have been.

But that post was removed by the LB censor.

One might therefore wonder how long this post will remain visible.

The bailiff would have acted after a Warrant of Execution was issued b Northampton County Court Central Ticketing Office.

You say that TFL rejected your appeal, thus went to Northampton to get an Order against you because of your non Compliance.

The fees are set in stone by the lord Chancellor, costs are agredd between bailiffs and Authorities and with Traffic mangement they do vary a lot!

With Transport for London fees of around £550 for non payment of a PCN are about right.

The most important thing here, has the bailiff left at least 24 clear hours between visits(letters)?
The Black rat (Rattus rattus) is a common (hence the accusation of being Pleb) long-tailed rodent of the genus Rattus (rats) in the subfamily Murinae (murine rodents). The species originated in tropical Asia and spread through the Near East in Roman times (another thing that we ought to thanks the Romans for, besides roads, aqueducts and public toilets) before reaching Europe by the 1st century and spreading with Europeans across the world.

A mutation of the beast now comes black leather clad, riding a motorcycle that looks like a battenbergh cake on wheels.

A skilled predator, totally ruthless with it's prey, but also known to be extremely generous in doling out tickes that can provide points for motorists who want to downsize from mechanically propelled vehicles to bycicles.

It's a dirty job, but someone got to do it!

My opinions are free to anyone who wishes to make them theirs, but please be advised that my opinions might change without warning once more true facts are ascertained

The bailiff has left over 24 hours between each notice, but in between them times i have been paying small amounts. I paid more yesterday and will be doing so each week. The bailiff is more than unreasonable, i haven't dealt with them many times before but he does not reason with you and will not help you out (making a payment arrangement) There is nothing i can do but pay them weekly how i am, some weeks more than others.

I wasn't exact when i wrote my first post on the fees but just fees alone as it stands now its £547.78 with a FINAL NOTICE. The bailiff hasnt even wrote a time on the letter, and i have 2 shar pei dogs so if he had rung the door bell or knocked on my front door the dogs would have gone crazy and woke me up which then i would have gone down to see who it was.. But nothing.

Im so stuck what to do!

Write to Marston and ask at what time the bailiff left the letters, especially with TFL, these must be recorded on his PDA.

This would tell you if you were indoors when he visited, some of the Marston's bailiffs have the poor habit of writing letters, put them through the letterbox without knocking.

It's not going to save you any money, but there are new brooms at Marston, and it could well be that the specific bailiff is going to be spoken to.

But otherwise yes, you are stuck!

                    Re: Marston Fees

Work out the debt you owe to the council, pay them. Work out how much you owe the bailiff in charges, pay that. Keeps the receipts and state to council and bailiff firm that debts are paid and send a cease and desit notice to bailiffs. After record any visits and letters withba camera and wait for the bailiff to cock up then file a form 4 or N1 regarding harassment. Job done
