    Hello,

    Good evening all. I am hoping that somebody may be able to help with an issue that I currently find myself facing.

    Approximately 18 months ago I was caught by a revenue protection officer travelling without a ticket at London Waterloo Station which was very stupid I know. However after taking all my personal details and going on my my way I heard nothing further and hoped that it had been forgotten about.

    This weekend I have returned home to visit my parents in Shropshire and have found a pair of letters waiting for me. The first of these dated 20th June is a further steps notice issued by London South East and Central courts specifying that I owe 301.30 and that as I have failed to make payment 'as directed' they are able to take certain steps against me to recover the monies owed (I received no prior correspondence to this.)

    the second letter I received is a warrant of distress issued by a firm named collectica acting on behalf of the courts demanding that I pay 386.30 within 14 days (dated 15 July). I have not lived at my parents house since January this year and as such was unaware of these letters. I am not disputing the fact that I committed the offence. However as I never heard anything prior to this and the deadline for repayment has now passed I am worried what may happen next. My mum said that a collections when y has been ringing for me but she has told them that I no longer live here and has hung up each time they have called. Please could somebody advise on my next steps? I worried that they may turn up here and upset my elderly parents or trick their way into the house and levy on their goods or that they may attempt to charge £215 for sending a letter to an address I so not live at. If I contact collectica directly is it likely that they will accept 3 payments of approx £130 without levying further charges to my 'account'? Even paying this much p.m will put me into financial hardship as I have other debts I am trying to pay off at the same time.

      It is highly unlikely you would be allowed to pay in installments at this stage, though you will see what is said about a Means Enquiry Hearing.

      As for seding information to the wrong address, you say you moved in January. I assume you have officially registered at your new address. If they have sent information to the wrong address, you should have a case.

        I would suggest that you straight way call the number on the Further Steps Notice and say to them that you have come back to visit your parents for the very first time since the start of the year to find two letters, one from the court and another from Collectica and that as you had not been living at the address that you have not been able to address this any sooner.

        If you had not received the summons ( as this would have been sent to a wrong address) the court should allow you to file a Statutory Declaration and this will have the effect of rewinding the matter back to the start.

        As you had not received the summons, you would have been denied the opportunity to enter a plea (guilty or not guilty) and to complete a Means Enquiry Form.

        Please do post back after you have called them.

        PS: When you call you should say that you have evidence that you do not live at that address.

              If they had sent mail on the 15 july letter from bailiff could have been dealt with sooner Once again we have someone not paying a railfare and getting caught do some people think its free travel?

                Agreed, but they didn't. This is not the parents' fault, it is an issue for the train passenger.
