    Their fees and demands are "highly suspect" anyway, as both demand letters contain a threat to re-attend to remove goods on which distress had not been levied and to charge for that visit, too.

      the date written in pen is 8/6 on the first two bits of paper and has 8th june 2013 written on the other two but no year not seen a liability order not even seen a bailif in the flesh but i wont answer the door

        Were the documents pushed through your door? If so, the bailiff may have attended when you were out. It is a legal requirement that, on his first visit, the bailiff serves on you a copy of the LO and Reg. 45, Council Tax (Administration & Enforcement) Regs 1992 (as amended). If he hasn't, any fees he is charging or attempting to charge may be difficult to justify or enforce.

          all the above paperwork was in a sealed posted envelope nothing was loose in the letter box

            At least the bailiff has a basic grasp of the Data Protection Act 1998. However, his non-compliance with the Council Tax (Administration & Enforcement) Regs 1992 (as amended) may mean he has difficulty enforcing any LO and fees. The demand letters may be unlawful if Rossendales have tampered with official documents and not complied with statutory provisions.

                Well, it's a result, though they are effectively overcharging by £42.50 - the latter two liability orders have each acquired a first and second visit fee, even though the visits happened at the same time.

                    In whose pocket would you prefer that money to be?

                    Don't follow it up with Rossendales, though. Wait until what you owe is more manageable, then take it up with the council.

                    Set up a standing order, so the buggers cannot engineer a default.

                      Engineering a default amounts to False Accounting and, almost certainly, Fraud by False Misrepresentation. Any certificated bailiff who thinks they can get away with something like that is seriously deluded and so is the management of any bailiff company who think they can get away with it.

                        standing order has been running for 3 months now

                        I just hope they get hold of him as its joint liability and the fact he was taking money off me and not paying the council tax so i am paying my share his share and what i gave to him to pay in !

                          looks like they are trying it on again i have been paying council a regular ammount for over a year now and rosendales are going for" refusal to pay " can they get anywhere on that ? i have never responded to their letters or seen a baliff and any post just gets returned to them are they just clutching at straws ?

                            Welcome back, but sorry to see you back.

                            Can I just clarify something please? You state you've been paying the council a regular amount for over a year now. How much have you paid in total? How much is left to pay?

                            If you can give those figures, they don't have to be exact, but as close as you can, then we may be able to do something about getting the council to recall the debt. Otherwise, I'm afraid it's the same tactics as before - you'll be an expert soon.

                            Also, have the council sent you anything further regarding the debt or have you sent them anything? If so, what?

                                If money is being paid to the local authority on a regular basis, Rossendales' statement that the OP is "refusing to pay" is not only unwise, it could also backfire on Rossendales and the local authority involved if any other form of enforcement or judicial action is attempted. One more reason why the civil enforcement industry doesn't need reform or regulation, but closing down altogether.
