Hello all,hoping to find a little bit of help here.My partner received a letter this morning from Equita (NOTICE OF APPOINTMENT AS DEBT COLLECTORS) £3,628.35 overpayment of housing benefit.My questions are can they force entry,can she ask for it to be recalled back to the city council and can they take possession of my car.Would be very grateful for any help.thanks Terry.

If they are not attending as bailiffs they cannot force entry, nor can they seize anything, although knowing Crapquita they may well claim they can, If they misrepresent themselves or otherwise make wrongful claims to be acting as bailiffs when only DC you could report them to OFT under Credit Fitness, and to Trading Standards (northampton TS are investigating Equita)

Would be very grateful for any help.thanks Terry.

the debt will be referred to a debt collection agency and likely action taken to a County Court Claim(CCJ)

If a ccj is obtained in your partners name only then NO they cannot touch your car in theory,..... in practice they often levy on any car they have 'reasonably assumed' (parked outside the house) to belong to the debtor and leave you to contest their levy!!!
