  • Marston bailiffs - n244 help?

    Hi all,

    ICurrently having some difficulty with Marston bailiffs. They are after me for 2 fines - that'll teach me for being young and ignorant - a parking ticket at £468, and an unpaid train penalty fare at £625. I recieved nothing from Marstons prior to a final notice for one of the fines, and some documents for the other fine. Ultimately, I want the chance to be able to pay the full amount I owe, but with a payment plan. I just cant do it in one go.

    My main concern is stopping bailiff action and figuring out paying the money back. So Ive been told to fill in an N244 form to halt any enforcement action until a hearing? Its just there are quite a few things Im really not sure on -

    1) Do I have to fill in an N244 form for each fine, and do I make the application to my nearest county court for each one?

    2) Who is the claimant? Marston? The councils that are written on the bailiff documents?

    3) Claim number - apparently should be on the original claim form but I don't think I have one, just the documents Marston have left. Is the claim number the same as the reference number that the bailiffs are using?

    4) Are there any hints/tips on what order to ask the court to make and why, and also in the witness statement, as I understand I need to show my income situation fairly clearly?

    Ive been going round in circles and just cant seem to get any clarification on these bits, any help would be HUGELY appreciated! Cheers

    Hi and welcome. N244 form is for dealing with court only. Can you please explain if you have had final notices from the original issuers before debts were passed to Marston for enforcement? Have these fines 'been through court already?

      Your unpaid train fare will be a magistates Court fine and therefore criminal. The PCN will be a Council debt passed from the Traffic Enforcement Centre and therefore civil. You may nee to start a new thread for one of these as otherwise it is goning to get complicated dealing with both here. For arguments sake leave your train fare one here and start the new one for the PCN. We will need some background information as to how these arose to be able to help.

        Thanks for replying both of you.

        I dont know if the fines have been through court already - I have a letter from Marston dated 15th march regarding the penalty fare saying they are in possession of a magistrates court order, no reminders will be issued etc. then a card dated 17th april regarding the same fine saying a distress warrant has been issued against me.

        I then have a final notice dated 15th march also, regarding the PCN, and then a removal notice for the same fine dated 17th april, so the bailiff is clearly trying to kill two birds with one stone which is making this so much more confusing!

        All I know is that the client for the PCN is Rushmoor Borough Council, and the distress warrant for the penalty fare is issued by Hampshire and I.O.W Magistrates court... you're right ploddertom, this will get confusing.

        So in regards to the unpaid penalty fare - It happened around november 2010, not sure on the exact date. I know I had a few letters after that asking me to pay a rapidly increasing fine, and being younger and ignorant, I ignored it. Now the letters Ive had from Marston over the past 6 weeks is the first Ive heard of it since.
