    Just spoke to the council the man on the phona said that as they had been passed to the bailiffs there is nothing they can do. I tried to explain about our vulnerable situation but he flat out refused that there was anything they could do. I knew thy wouldnt be helpful

          There is EVERYTHING they can do, they remain 100% in control of the debt and can recall it from the bailiff anytime, send in a Formal complaint to Head of parking council CEO, elected leader, and your MP, the council are wholly liable for their bailiffs reluctance to recognise your vulnerability under the national standards.

          If hey have levied the same goods more than once then one of the levies is unlawful anyway, along with the fact the car would not even clear the bailiff fees if taken and sold. Plenty of grounds to complain.

                Send marked Formal Complaint , put in it that you are vulnerable due to being wholly reliant on means tested benefits, the council officials are being obstructive and along with their bailiffs for which they are wholly liable jointly and severally, are ignoring ther national Standards, put that the goods levied would never fetch enough at auction to evej clear any of the removal and sale fees let alone any of the debt. Also if the car has been levied twice, then the second levy is unlawful as the bailiff would them be levying HIS property, a no no under the law. Other Beagles can also add helpful content for you.

                    Am I to understand this neanderthal deliberately blocked a public highway and used coercion to levy on and seize the car? If this is correct, the levy is, IMHO, totally invalid and the bailiff's actions potentially illegal. Any levy must be gained by peaceable means. That means bailiffs must not use physical force, coercion or deception in order to gain or secure the levy. In your case, $*** for Brains committed an offence of wilful obstruction of the public highway, an offence under the Highways Act, at the very least. Following someone is also an offence, but under the Public Order Act 1986. I have to agree with the others that this sounds very much like the bailiff levying on goods of low value in order to gain a financial advantage for himself and B & S.

                    Your local police force will be Hampshire Constabulary and from what I know of them, they don't take kindly to this sort of behaviour by certificated bailiffs. I cannot speak for those stationed on the Isle of Wight, but I do know those on the mainland "kick ass" where bailiffs are concerned.

                        You don't have to contact the bailiff and I strongly recommend that you do not. It never serves any purpose. Bailiffs never listen.

                        The local authority involved cannot wash it hands of this. It is entirely responsible for the actions of the agents it employed to collect its alleged debt. That has been subject of several county court judgments.

                        Perhaps the next time this lamentable council attempts to charge a dog owner when the animal fouls the pavement, it will accept the owner's plea to 'refer the matter to the dog'.

                          Which department of the council should I phone?

                          Hypothetically speaking where would I stand if the car had been sold in the last few days? The bailiff didnt actully see me driving it :S
                          B & S are seriously extracting the renal excretion as regards fees which should be something like -

                          PCN No.1

                          PCN = £112.00
                          Letter = £11.20
                          1st Visit = £34.50
                          VAT = £9.14
                          TOTAL = £166.84

                          PCN No.2

                          PCN = £82.00
                          Letter = £11.20
                          1st Visit = £28.00
                          VAT = £7.84
                          TOTAL = £129.04

                          Unless the vehicle has been removed by the bailiff, it is an upfront fee and, accordingly, fraudulent and illegal

                            Ok I've just been into town to buy a ream of paper and some fresh printer ink. I will write the letters out later when my son has gone to his dads and then if I post it on here will you wonderful beagles take a look at it for me? I went to CAB today and they werent very helpful really...I told them about the vulnerable persons circumstance and they didnt really seem to understand and certainly didnt know of the legislation. I also asked them about the notice being served on the same day as the seizure if that was illegal and they didnt know, they said I could challenge it.
                            BB just to be clear, he blocked the car in the street and informed my friend (not me) that he intended to sieze the car, (after he had followed him halfway round the town) he then came back to my address and posted the seizure notice through the door.
                            I'll be starting my letter writing enslaught around 5pm. Hope some of you will be around to help

                              Could you describe EXACTLY what the bailiff did and what happened leading up to him doing so. It is very important that these facts are accurate as the bailiff may have committed a criminal offence and the levy and seizure may be invalid and unlawful/illegal as a result.
