  • Swearing a declaration.

I've just noticed that I may have been rude. So, I'd like to say hello to the everybody and that I'm very grateful for the words of advice and the sharing of experience that everybody has posted to the forum.
Would anybody be able to give me a bit of advice please.
I've been paying an outstanding court fine for an offence on a distress warrant to Collectica. The original fine was £400 which has has been paid off to them in instalments. Though I haven't received the most up to date statement I have been advised by three different agents at Collectica on three seperate occasions by phone that the original court fine amount of £400 has been received (£423 in fact) and that the original fine amount was now paid and all future instalments are paying for their fees which are an £85 admin fee and £215 attendance fee (which was just a letter as nobody actually knocked at the door).
Now that they have received the fine amount which they've acknowledged they say that they can enforce with bailiffs attendance for the further £300 in fees. I have sent them a letter refusing to pay their fees as I am entitled to do and made a formal complaint about their fees to the court using letter templates that I was advised to use online.
I'm still a bit nervous about this and because I am struggling financially I am living in a room at my mothers home which is a rented property. I own nothing personally of value.
My question is Is it advisable to have a Declaration that all the property in the house just belongs to my mother (as per your useful letters template and if I use your template does it have to be signed by a commissioner for oaths or solicitor? Should this then be sent to Collectica before they send a goon round?
Furthermore. When I first spoke to Philips (who've sinced changed their name to Collectica) back in November 2012 I asked to make payment by instalments and they said yes that would be £120 a month. I said that there was no way I could pay that figure and suggested £50 a month which they refused. Then after keeping me on hold for a little while the agent said that the Court would only let them accept £22 a week or £94 a month. In hindsight I've realised that at no time has anybody offered me a means test to see whether I could pay this amount. Even though I said that the amounts that they suggested was difficult for me. In the end I agreed to £22 a week which I've paid, though it's been a struggle.
    Your advice is appreciated.

The Attendance Fee which you say was a letter, was this received via Royal Mail or by hand delivery?

Hand delivered letter. There were 3 people and a dog in at the time the letter was delivered and no attempt was made to knock/ring contact anybody indoors at the time.

That's a usual trick. However it does mean that they can claim to have attended. Have you asked to see the Warrant to make sure it is valid? Have you also checked to see if the Bailiff is suitably Certificated?

So far I haven't seen an actual person. Everything has been by post except the one hand delivered letter which was posted through the door without knocking or trying to contact anybody actually in the house. I've been told that that is a common trick by bailliffs. Do I contact Collectica to ask them to send a copy of the warrant or wait for the actual bailliff to turn up?
