  • CSA sending baliffs after agreement made in court

    So on the 4th Feb. this year I went to court because of finacial strains I have had over the last year, I am behind with my CSA payments and spoke to the CSA representative at the court and arranged to begin paying at a certain amount per month and as my debt situation got better I would increase the payments to clear my debt.

    On Saturday I received a letter saying that bailiffs were going to arrive at our house to basically take what they could.

    I called the CSA more than a little confused because the officer at the court had told me that he would accpet my offer and even sent a letter confirming he had (though there were no figures) he sent a standing order form to send to my bank, I even went down the next day to see if it was ok to do this online as it was a lot easier.

    Back to the call with the CSA.

    Quote: "I'm sorry but we have decided not to take your offer, what you will be paying will cover your regular payments but the excess will not cover what you owe"

    I explained I knew this and told the woman on the phone what I had explained to the officer at the court.

    Her response was basically 'We have given this to the Bailiff, you have to take it up with them'

    Surely they cannot renege on an agreement made in court?

    and if they decided to renege should I not get a chance to go back to court, find out why and at least have a chance to get some sort of deal made?

    I know I am not alone in knowing that the CSA think they are the police and judicial system all rolled into one - I mean losing your licence for being unable to pay!!!

    can I have any advice please

    Was the arrangement you refer to confirmed by the court? If it was, I cannot see the court being too happy with the CSA going against this.

      You can seek urgent judicial review to require suspension of the enforcement actity, as you have a legitimate expectatoin of being able to rely on the CSA officer / representative's word in court and the agreement made with them. You need an urgent Probitory Order. A Law Centre www.lawcentres.org.uk may be able to help you with this.
