Bailiffs charging enormous fees and trying to get away with it.

Hi ya all,

Please help. I've got bailiffs on my back for two outstanding parking tickets. One totals £391.84 and the other £546.04. The parking fines were £120 each so take that away from these balances and you'll see what I mean. Thats £271.84 and £426.04 for a couple of letters. Is there a list of fees they have to charge and keep to? I am gradually sinking under their twisty turny ways and getting confused.

Its so easy to get confused with these aliens. I need some real solid help here please.

At these rates, I couldn't afford to.

I don't know the name(s) of the Council(s) but if there is a genuine warrant outstanding on either of these PCNs, I'll give you the money mesself. Newlyn will try to convince you that there are 'warrants' and probably print them on their template software and send you a copy of these fakes to make this smoke and mirrors trick look more convincing.

Newlyn has no legal authority to print warrants.

Hiya all newbie friends,

The bailiffs are getting nasty now so I've got to up the game.

Can anyone tell me what hours they're supposed to work and if they work seven or five days a week please.

I've sent off my first letter asking about charges, etc., and also asked Lewisham Council for copies of the paperwork. LC told me it'd take about two weeks for the papers to come through.

WhenI went to the car park where I got the ticket I found the signs had changed. Does anyone know if this will make a difference please?

If the signs have changed since the ticket was issued, you will need to find out when this happened and, if the regulations have changed, when. It is also handy to ask for a copy of all Traffic Management Orders and Traffic Orders for the car park under the Freedom of Information Act.

If you don't want to identify yourself to them, you could enter 141 on your landline first, to stop your number displaying at their end. You could explain you're worried about when they might call at your home unexpectedly. I feel they would tell you this information, directly.

Can bailiffs visit when they want

Most bailiffs have a legal right to come to your home at any time of day or night to try to take your things. However, in practice bailiffs shouldn’t come at the following times unless the court has specifically ordered it:

• before 6am
• after 9pm
• on Sundays
• on bank holidays
• Good Friday
• Christmas Day
• other religious festivals, as appropriate.

Other rules about when a bailiffs can come to your home apply to particular situations:

• county court bailiffs have a policy which says that they should come at a 'reasonable hour' and not on Sundays, Good Friday or Christmas Day
• High Court bailiffs need permission from the court if they want to take goods on Sundays
• for rent arrears, bailiffs can only come to your house between sunrise and sunset, and not on Sundays
• for income tax arrears, if the bailiffs have permission to force their way in, they can only do so during the day-time. HM Revenue and Customs has a policy not to take goods between sunset and sunrise, on Sundays or on public or bank holidays, whether or not they have permission from the court to force their way in.

If the bailiffs come to your home at a time when they shouldn’t, this could count as harassment. You should get further advice from an experienced adviser, for example, at a Citizens Advice Bureau. To search for your nearest CAB, including those that can give advice by e-mail, click on nearest CAB.

Thanks Gravytrain - people must be made aware that they do operate outside these times though. There is no compulsion for them to stick to guidelines, though I believe this will be changing.

To the OP - have you sent the letter for a breakdown of the fees off yet? If not, you need to do so - apologies if I've missed it in skimming though.

Hi there labman, yes thank you I did send the letters on Monday. Does anyone know if they will reply? If they do not reply and I send the second letter as a SAR with the £10 and they do not reply, do I have any recourse?

Hi everyone and all,

I've had some good news from the bailiffs after I sent them the first letter asking for details of charges, etc., they have written to say they will be investigating and will get back to me in ten days.

I also sent them a Cease and Desist Letter by recorded delivery.

I don't know which one did the trick but I now have to do a N244 to the Court to try and totally get rid of the bailiffs. Unfortunately, because I have no details, eg. PCN, or other photographic evidence I am finding this very hard. I have sent a by hand letter to the Council requesting copies and have been told it will take up to two weeks.

I'm hoping no-one turns up in the meantime. Also, I am doing a Statutory Declaration. Will this hold them off??

I have a lot of my mum's property at home. IF the bailiffs do carry on and try and seize property, can they take her property please?

So far I am breathing a little easier, thanks to yea all.
