  • bailiffs please help

    Hi,

    Was hoping for some advice. I've just received a bailiffs removal notification through my letter box stating that they will be attending my property on the 14th Feb\ 13. It says that I need to pay £703.60 in order to cease this action taking place. According to the notice this is for a parking penalty!! This seems high for a parking penalty, also I haven't got a clue what they're talking about. I wasn't aware that I had any outstanding parking tickets.

    The notice also says removal booked m3pr I think?? It was put through the door by excel civil enforcement ltd.

    What should I do as I don't wanna pay that amount of money.

    I shold also add that i have moved property 3 times in the last 2 years twice of which are in the last 12 months so maybe any fines went to a previous address.

      M3PR are part of Excel. Have you had parking tickets in the past? Have they told which Council this is for? When was the last time you moved?

          I dont have a PCN number the notice doesn't have one on it. I last moved Otc last year so only been here for almost 4 months now

            Ive had parking tickets in the past which I've paid at 1st available option. They haven't told me what council this ticket is from either

              You will need to contact them to find the PCN number as without this you cannot do very much. If you then contact the Traffic Enforcement Centre they can email you some forms to fill in and if you then return these before 4pm they can be dealt with the same day halting all further action. In the meantime you must move your car NOW as this will be listed on the Warrant they have, even if you have changed your car and it is parked outside or next to your house it is likely to be clamped and/or removed on sight.

                  If they ask why all you need to tell them is that you need to check if you actually owe it in which case you will pay - gives you a bit of time hopefully. Do not tell them you will be applying for an Out of Time at the TEC, otherwise they will be with you quickly. They know they are not supposed to data cleanse the warrant but are hoping you don't know that.

                    I've managed to get the PCN and got as much details from the lady I spoke to as was possible. She said that It originally went to court on the 3rd of March 12 and was for parking in a restricted area. I moved address in Jan 12 but didn't notify the dvla as I sold the vehicle 3 months later. What is data cleanse please and what do I do next?

                      The most important info you need is the PCN number as this is how they track the Warrants. You need to contact the Traffic Enforcement Centre first thing in the morning - have a reaf of http://www.justice.gov.uk/courts/nor...sked-questions , contact details may be on another page. Explain what has happened and you know nothing about this. They should email you some forms to fill in, return them ASAP, if filled in OK they inform the Council & all enforcement must stop immediately. The ticket may be reissued and you get the chance to pay at thee original rate, all Bailiff fees are scrapped.

                          In answer to your question about Data Cleansing, where bailiffs are concerned, it is the unauthorised - and illegal - changing of details on a warrant. Strictly speaking, if it becomes apparent that a warrant has been data cleansed and neither Northampton TEC and the LA involved don't know anything about it, the bailiffs have an invalid warrant and may be committing one or more criminal offences. It would also make any seizure or attempted seizure unlawful, if not, illegal.

                              Warrant of execution
                              75.7

                              (1) An authority seeking the issue of a warrant of execution must file a request –

                              (a) certifying the amount remaining due under the order;

                              (b) specifying the date of service of the order on the respondent; and

                              (c) certifying that the relevant period has elapsed.

                              (2) The court will seal the request and return it to the authority.

                              (3) Within 7 days of the sealing of the request the authority must prepare the warrant in the appropriate form.

                              (4) No payment under a warrant will be made to the court.

                              (5) For the purposes of execution a warrant will be valid for 12 months beginning with the date of its issue.

                              (6) An authority may not renew a warrant issued in accordance with this Part beyond the 12 month validity period but, subject to paragraph (7), an authority may request the reissue of a warrant during the 12 month validity period.

                              (7) Where the address of the respondent has changed since the issue of the warrant, the authority may request the reissue of the warrant by filing a request –

                              (a) specifying the new address of the respondent;

                              (b) providing evidence that the new address for the respondent does relate to the respondent named in the order and against whom enforcement is sought; and

                              (c) certifying that the amount due under the order remains unpaid.

                              (8) Where the court is satisfied that the new address of the respondent given in the request for the reissue of the warrant relates to the respondent named in the order, it will seal the request and return it to the authority.

                              (9) The authority must prepare the reissued warrant in the appropriate form within 7 days of the sealing of the request to reissue.

                              (10) A reissued warrant will only be valid for the remainder of the 12 month period beginning with the date it was originally issued.
