  • Marstons Bailiff's!

    Hi, i am after some help and advice on Marstons Bailiff's....

    I recieved a letter ( through the post) on 31st 2012 from Marstons stating that i owe them £310.84. They say i have 7 days to pay in full or they will send someone to my house! As i read on, i realised it was my local council that soldthe debt to Marston, so i contacted them and asked for them to explain. Apparently it is a car parking fine which was apparently issued on 28th January 2012! So nearly a year ago! Well i never had a notification on my car saying i had a fine, and i certainly have never recieved anything through the post telling me i occured a fine on the 28.1.12. I spent the day arguing with the council, a\s they kept telling me they sent numerous letters to m,y previous and current address telling me about this fine.! I have recieved NOTHING.
    Anyway after NO HELP from the council, i have ttried to contact Marston Group, but i got no where, only told that this number was a payment line! Iv emailed them stating that i am investigating this matter and am currently getting legal advice.
    I basically just want to know what i can do if they turn up at my door? can they enter my home using a locksmith, as i rent my home? any help and advoce would be much apprichiated.

    Send them a SAR (Subject Access Request), under the Data Protection Act 1998, asking for copies of all the information that they hold on you. Specify that you expect actual copies of the above correspondence to be included.

        You don't need a SAR. Have a read of this http://www.legalbeagles.info/forums/...rking-Offences .

        You need to contact the Traffic Enforcement Centre and ask them what address is on the Warrant and if it has been amended. It sounds as if all notifications have gone to an old address in which case they should allow you to complete an Out of Time which if granted will halt all Bailiff action & charges.

            Labman: You are of course right.

            As an aside, it is worth noting however that a SAR is more powerful, and may force the disclosure of collateral documents that may be of interest.

              Certainly a SAR has its purpose, and can be very useful. It's just not the right way forward at this time, in this case. :tinysmile_grin_t:
