    hello, i need help massively!
    Ive done a ton of reading but cant seem to understand in order what i need to do.
    heres my problem.

    i received a hand delivered from equita stating that a bailiff has called at my home to execute a warrant issued by a court ( in which it was just posted, there was no knock as my sister was in the kitchen!)

    i called the number of the bailiff and asked what the hell was going on.
    he said i ow £370 for a parking fine from January 2012, in which its now November 2012.
    i didnt even no i had this ticket! i live in an area where kids find it funny to rip these off the car.

    But heres the main issue of this. im not disputing the fact i have to pay a ticket, its more of the fact that i received no letters what soever from the council saying i owed anything, nor did i receive anything stating they had sent my case to equita. and then to make it worse i didn't even receive one single letter from equita saying they have my case and require payment! All i have received is this hand delivered letter. its the first thing i know about it and know they demand £370.

    I have 2weeks to make the payment.
    My questions are:
    1) if i trace is all back to the beginning to the council, if i ask where they had sent the letters and my address was wrong, would they have a leg to stand on as i have not been informed of any debt. Would they then have to withdraw the whole case from the bailiffs as they had sent it to them illegally without me knowing anything about it?
    2) is £370 fraudulent and excessive from a £70 fine? ive read in places they cant charge me more than £180.

    Also would this be a case to write a statutory declaration??

    Anything would be appreciated ASAP!

    Do you have the PCN number? Do you know which Council issued it originally? Have you moved since the "offence"? Have you asked what address is on the Warrant?

      yeah i do have the pcn number and i do know what council it was as it was issued outside my house! And no i am still living in the same address.
      And i havnt asked the address on the warrant but it is for my car as i asked him the details and the letter has my address on which was also hand delivered.

        If I were you I would ring the Traffic Enforcement Centre in the morning and tell them you have been attended by a Bailiff for a PCN you know nothing about, you should also ask for the EXACT address on the Warrant. Hopefully they will email you some forms to fill in & if returned before 4pm the same day all enforcement action should be halted & the Council may reissue the ticket at its original rate.

              i sent the relevant forms off today for next day delivery.
              is it a case of just waiting now? what happens next?
              do i need to let the bailiff himself no that i have filed an out of time statutory declaration?

                I would check by phone to see they have them & ask what happens next. The Bailiff will soon find out what you have done, no need to do their job for them - of course if they are reading this then they already know.

                  Well if he is reading this, the amount he wants to charge is a ridiculous fraudulent amount anyway so i would contest that aswell before paying anything! after all he will just have to wait till i have the money, my cars on finance so that cant be taken, i dont personally own anything as i live with my parents so not much i can do really except offer money as and when i have it.

                  and ok i was told at the post office the letter will be delivered by 1pm tomorrow, il call around 3 to find out whats next.
                  I wont call him or anything then, il just wait till either he calls me and then il kindly say what im doing or yeah he will find out soon!

                      they have recieved them and sent to my council.Bailiff action has stopped now until the court decides. such a relief!
