  • Jacobs Bailiff again

    Had onther 48hour removalnoticefromjacobs.This time I got assigned to the rather rude Mr J*****f. He's hand delivered letters for two outstanding amounts of council tax. One if £935 the other is for around £1200. I can raise about £100 and pay £75 per month but he's refusing.
    So far he's not gained entry or made a levy.
    One car is the subject of a hire purchase agreement although thishas been terminated. The other car is my wife's. She is disabled and in receipt of DLA.

    We have not made any payments recently but can start .

    Should I move my wife's car to a neighbours a few streets away?
    Should I pay the bailiff direct or start paying the council ?
    I doget some council tax benefit.

    Is your wife's car from Motability? If not does she get a free tax disc?

    At the end of the day it is up to you who you pay, it is your money & there is no law that says you have to talk to or speak to a Bailiff. If it were me I would pay the Council, say £10 every Thursday. You will have to budget for lawful bailiff fees but providing you deny him access to your house or prevent him obtaining a levy outside then this can be capped at £42-50.

    Not being nosy but may I ask about your wife and her condition. It may be that you could be classed as vulnerable in which the account should be haned back to the Council.

        I disagree ploddertom, why should this member pay what you call lawful bailiff fees?

          Because they've been charged lawfully I imagine.

              Are you suggesting that they pay no lawful fees, if so then I'm afraid you are playing with fire and would end up costing the OP more in the long run.

              With CT the Bailiff fees are paid first with any balance going to pay off the Council. As an example you owe £500 and the Bailiff fees are £42-50, you pay the £500 and think all is paid up. Wrong, the £42-50 fees are paid first meaning only £457-50 has been paid off the debt. The Bailiff can and will attend to enforce the rest, you have lowered your guard and the Bailiff levies on your car adding another £50 say to the debt, you then tell him to foxtrot oscar so he slaps an Attending to remove fee of £175 on and may even remove, so for the sake of the lawful fees you have ended up another £1k out of pocket.

                Despite my wife being disabled the council have refused to take the case back . not cant wont . As the bailiffs wont come to an arrangement I'll pay the council online evry month. Although I have been talking ot a printer who will print me 1p cheques and I was going to paythe council in 1p cheques as these will cost on average 15p each to administer .
                Just got to hide the wife's car . No it's not motability and although she is entitled to a free tax disc it's currently adorning our other car as we only bought this one thursday .

                  The only answer to this is that legislation allows the bailiff to charge these fees, and it also states the bailiffs are entitled to visit in these circumstances, whether or not they're invited. Fact!

                  Given everything is legitimate and lawful Ploddertom's advice is absolutely spot on. Fact!

                    You do not believe in any other way, you only encourage members to pay pay and pay then on the other hand you advise to get rid of bailiffs and go direct to councils. It is the council that hired the bailiff to which he has no authority to be at your property, why dont you advise members to put a stop to it as you say on various other threads about going direct.

                        Have you been in touch with your local Councillor(s)? Do they give a particular reason for their intransigence? It may well be the time to put finger to keyboard & write to the Council CEO marking both letter & envelope as Formal Complaint, reminding them in the process that they have agreed to abide by the National Standards for Enforcement Agents.
