    Dear Numpties,

    Thank you for your email, in which you sought to elucidate the untruths told by Newlyns and especially the nonsense concerning the bogus "enforcement fee". It is a pity that the complaint was only deal with at "stage 1" of your procedures, as this seems to consist solely of asking the enforcement company for their comments and relaying those comments to the person who has complained. This is simply inadequate and rather gives one the impression that the complaint had not been taken seriously.

    It must be pointed out to you as the local authority controlling the actions of Newlyns in this matter, that you are vicariously responsible for their actions. It should also be pointed out that, as distress had not been levied on any of my goods, it is therefore inappropriate (and absurd) to charge any fee or "reasonable costs" for "removing goods, or attending to remove goods where no goods are removed".

    I therefore request that my complaint be taken further in your complaint procedure to the point where it is considered in a sensible manner by a council employee rather than merely referred to the enforcement company. Ideally, this matter should be referred to your Head of Revenues.

        And copied to the Council CEO, the elected leader your local councillor who should be contacted and informed about the muppetry indulged in by the Officers of the council he is elected to, and your MP

          Many thanks, once again...Medway really are not up-to believing that there is a discrepancy with Newlyns...

          The letter from Newlyns was the customary final notice Baliff removal letter...in red..paragraphs are;

          A Baliff will be attending your property within the next few days to remove your goods to settle your outstanding debt...... ( i don't live there any more haven't for months now and even after informing my ex suffers from bi-polar, which the same said council have a care worker assigned to her because of her condition, and my youngest is on the autism spectrum)

          At the time of the visit we may remove without further notice goods including motor vehicles even in your absence .......


          As I said standard letter..

            Medway and Newlyn deserve all the odium and carp coming their way, involve your MP and local councillor, show them what muppetry is perpetrated in their name by unelected officials . Wonder if there is a Common Purpose infestation in that council?

              Firstly I would like to thank you for your comments. I can confirm I have investigated your concerns and discussed the points raised with the relevant service area, please see my response below.

              As previously explained in your stage 1 complaint response, the fees charged by Newlyns bailiff are in line with the required regulations and there has been no duplication of fees.

              However, Medway Council are currently in the process of changing bailiff companies due to a recent completed procurement process and Medway Council are in the process of reallocating warrants to the new bailiff companies, we are therefore in a position to allow you to pay the council directly the outstanding sum of £97 against Penalty Charge Notice and remove the additional bailiff charges.

              We hope this meets with your satisfaction and would ask that you pay this amount by 23rd May 2013

              So they are not admitting to the fees being incorrect, but at least I can pay the charge without bailiffs fees...in my book a result....

              I will of course pay this, I have never ever said I would not just wanted to pay what was due...

              Hopefully I'm not being a little premature here, but is this really over ??

                Fate does, indeed, have a strange way of working. I wonder how Newlyns managed to lose their contract with the local authority who issued the PCN? Too many complaints of sharp practice and inflated/unlawful fees, perhaps?
