    Hi - Can anyone help me dealing eith Sherforce?
    Earlier this year I had a courtesy car following an accident, it was provided by Drive assisst, the cost of the car wasmeant to be covered by my insurance company, In August following no contact from my insurers or Drive assist a chap called at my door when i was out saying that I owed a couple of thousand pounds for the "hire car", that I had been taken to court ( i had nothing in the way of paper work from the courts) and that they were there to collect the monies owed. I was not in so the chap (who was quite aggressive and insistant) talked my husband into making an agreement in my absence for us to pay £50 a month(no papaerwork ws provided, filled out etc) and that he would send a payment card thru the post (it never arrived). We assumed everything had been sorted via the insurance company as we heard nothing more till yesterday morning when I was woken to an extremly aggresive and persistant woman telling me there was a baliff van in my postcode and i had to pay £600 there and then and then a futher £50 a month on going orthey would come straight round and gain entry to my house by force if necessary and remove goods to the value etc . Itried to explain that i knew nothing of this so called debt and the only paper work i had seen was a computer print out, no official paperwork, letters, court details etc but she would not listen. I rang the insrance company who said that my cover was fine, i had extra legal protection etc etc and they could not see where this had come from, they advised that i rang the police aand logged a complaint and they would look into things more on monday as they were limited to wht they could do on a weekend. I am very confused as to what i can do and slightly terrified that these people will turn up even tho they didnt arrive yesterday. Can anyone give me any advice?

    i t mightbeascam it might not. But everyone collecting a debt should be able to show paperwork . A bailiff woil havea certificate and documents from the court. Dont Let them in under any circumstances. Check with the insurancecompany that there is nothing otstanding.check with the car hire people that there is nothing outstanding. Get these in writing or at the least record the conversations.

      Have you spoken with your insurance company about this? I would have thought if you were covered for a hire car and they arranged it for you then they are responsible for the cost.

      If you had no claim pack in relation to the ccj and the first you knew about it was when Sherfarts knocked on the door, then you apply for a stay of execution to the writ very very important you do this asap and then make a further application to set aside the Judgment. that you were not aware of the claim having been made you were therefore unable to defend it..

      To do this you need to download from HMCT's website two x form N244 The stay could be made your local County Court if that acts as a district registry to the High Court, we always recommend you take it to the Court in person and express the urgency of it comes about by threatening behavior by the appointed HCEO, quite often there is a 'spare Judge' who can hear your application there and then...so worthwhile to go in person. The set aside is ok to submit to your local Court, there are fees involved to lodge your applications but if you receive any form of benefits eg. tax credits, you can also download form ex160 for fee remission.

      Sherfarts are all mouth and the reality is..... if you deny them access to your home and do not permit them to levy on any goods outside your home (cars are a favorite for them to get a levy on) then there is little they can do. They do have the right to force entry to a garage but even then it must be detached from your main dwelling.

      Your husband cannot agree to make arrangements to a repayment plan to a debt that is not his ...that is for the debtor to agree...so I suggest Sherfarts are totally out of order once again and a formal complaint should be winging its way to them straight away.

        It is clear that what has happened is that your Ins Co have failed to pay the bill. I would assume the docs for this were all in your name and went to your Ins Co and are sitting in someones "In Tray". As the bill was not paid the Claimant has applied for and been granted a CCJ in your name, following Judgment no monies were received so they transferred it to the High Court for enforcement - hence why Sherforce are involved. You should check your Credit File tonight and get on to your Ins Co first thing in the morning to get this sorted.

          If this is what has happened, the OP would be within their rights to seek damages against the insurance company and the car hire company.

              That comes as no surprise to me, PT. Unlawful repossessions of motor vehicles were taking place when I was in the police force. We found it was easier to seize the car and make the repo morons catch the bus or a taxi back to their office. On one occasion, the repo morons' office was somewhere down in Sussex and they started bleating about how they were going to get back, whereon our Area Car driver said to them, "I couldn't give a **** how you get back. You shouldn't have tried to illegally repossess the ****ing car." The repo morons, obviously, weren't expecting to get a taste of their own medicine and meekly walked off in search of the nearest tube station.
