  • i need help as an notice of distress was forced on me yesterday

    mr lyon enterd the house without being envited as me and my husband was looking for a reciespt and i ask him to leave he said he a the right to come into my home . and he keeped made us call my mother in low to make a payment of £500. on her credit card then walked all though the house i told him not to go in my sons room but he said he had a right to go through all the house and all the items will be sold to pay off the dept i told him that the landlord had left some of his dads thing here and he put them on the list too aswell as my son things he was rude and very intimadating after my hubby left to go back to work made me sign the papet by thretning me and adding the coast of a van £140. walking possession fee £12 levy fee £53.79 attendance fee £24.50
    still not seen a warrent as he said he has one no letter from the court too i feel so vilated
    ps £1760.73 for poll tax in 2006 to 2007 and 2008 sept as we handed the house back to the morgage compony
    after doing research i feel such a foul for letting somebody bully me xxxx

    Did this bailiff assault or push past anyone in order to gain entry or stick his boot in the door? If so, he has problems. Big problems. And so does the local authority who employed this numpty. Which local authority and which bailiff company is involved, please?

      he did not push past us to get in but he opened the door as i had closed the door to help my hubby to search for old letters as we thought we had payed in 2011

          Unfortunately it does sound as if his entry was peaceful & lawful. I note you asked him to leave, was this before he started to write his levy - by rights he should have left but the difficulty is going to be you word against his. Can you tell us exactly what goods he wrote on his Notice of Seizure? By the way his fees are wrong, sounds like another of Marstons bullies.

              he knocked on the door when my son martyn aged 22 was just leaving and martyn shouted me to go to the door , when i got to the door the door was open and the man ask was i wendy glithero i said yes and he said im from the courts and have a warrent as you owe over £2000. in council tax i need a payment now i said i think we have paid this last year to a man and he got on his phone he said it was to the council and we have not paid i told him to wait there as i was going to phone my hubby when he got off the phone he kept demanding money i told him we where on low income and have help to pay to the rent and get working tax credit he just kept saying you have to make a payment for at least £500. and i empted my pocket on the door step only have £4. in change thats all i have got.I told him my hubby was on his way he said he was going to wait in is van but he had a group of people on route to take all our belongings and we would be charged for that and a tow truck was coming too and we would be charged for that too . he went to the van to wait . as my hubby jeff got here he stopped at the van and said he thought it already had been paid he stayed in the van for a few moment and my hubby came in the house closing the doors as there are to doors to are home . we was going through paper work when we heard the door open i went toward the front door catching him coming through the second door i told him to get out as i have not invited him in , he said he has the right to walk in the house and take our belongings. My husband was still looking for the confirmation of payment from last year in the conservatry at the back of the house. He then said to me I have already phoned the council and its not been paid you have to pay now as there is a van on the way with a group to remove your things have. My husband was still in back of the house looking for the paperwork but he just kept going on that we have to make charges against you if the van gets here and the tow truck my hubby ended up phoneing his mum and paying £500 on her credit card and had to rush back to work before he got he sacked for leaving without a reason . so i was left in the house on my own with him and he just he phone his office who said they would only expect £100 per month to pay off the rest i said i could not afford that and i kept saying please leave he said he would not till he had it all sorted and so i stood in the living room i told him that some of the furniture was the landlord and my sons he said he didn't care he was going to write them all down and the landlord and my son would have to prove that they belonged to them so he got up off the couch and started to right the items down i told him not to put my sons ps3 on and the landlords conservitry furniture and not to go into my sons room but he pushed past to enter his room and then pysically ripped my sons laptop bag out off my hands and opened it to write it down after a hour and half of him walking through my house and me at 5ft 1 and him over 6ft intimidating me into signing i give up and signed i was very deflated and upset. he did say he was not going to leave until i signed as i shouted for him to leave

                      It's hard to say if this bully has a valid levy or not, but physically ripping an article out of your hands is a definite no-no. That is, effectively, assault and that too, is a definite no-no.

                      Did he hand you a copy of the Liability Order and Regulation 45, Council Tax (Administration & Enforcement) Regulations 1992 (as amended) as he is legally-obliged to do? Do check with the local authority involved as soon as possible to see if you do, indeed, owe them money. If not, both Tameside Council and Marston Group are in it up to their necks.

                          Best way of uploading any scans is to convert them to a PDF file. If you download the likes of CutePDF http://www.cutepdf.com/ . It will install as a printer so when you go to print change the printer to CutePDF and instead of printing a hard copy it will create a PDF file instead which you may then upload.

                            We need to establish what goods may be property of another, or exempt and see if what is left is enough to satisfy the debt you have. You need to speak to someone at the Council and ask the following questions:
                            1 - how many Liability Orders they have against you
                            2 - the dates they were obtained
                            3 - the addresses they were for
                            4 - the period of time each covers
                            5 - how much each one was for
                            6 - how much is still outstanding
                            7 - the dates they were passed on for enforcement
                            8 - the dates & amounts of any payments
