    To the best of my knowledge and belief, the alleged "warrants" Marston Group knock up on MS Publisher or whatever, are, basically, forgeries and not worth the paper they are written on. However, because few police officers are familiar or trained in baliff law, they don't know this. Unless this practice is stopped by HMCTS or the MoJ, this practice will continue.

      It certainly didn't show the policeman in a good light at all,,and nor do some of the other videos I watched today,,seems knowledge of bailiff law isn't on the agenda ..

        OMFG... disgraceful I agree with everybody's comments and yes you seriously need to try somehow to get this sorted, I myself am dealing with Marstons and I know that they knocked on my door last week but left no letter or notice and I know that they are gonna pull a fast one by saying that they attended, me for one having learnt from previous experience with Bailiffs is this.....
        1) NEVER open your door this is the " golden rule" ( not even on a chain)
        2) Don't even bother talking to them via phone or through the door as it is pointless as they are a law unto themselves
        3) The police ( like in the video) are powerless ..I remember about 8 years ago when they threatened me I said I will call the police they replied go ahead they won't do a thing
        4) lock your doors, windows, back doors, patios and move your car
        ......and sit tight till you contact the relevant person for the reason why the bailiffs have been called in the first place as they are the only people that can stop them

          Found this guy while clicking through Youtube vids of Bailiffs, he's a freeman of the land and refuses to pay the full amount of Council tax because he doesn't want to pay for council officials to be driven round in limo's and partying at his expense.
          Here is a link to the website were he goes into detail of how the councils and the courts deal the unpaid council taxes, it makes very good reading to say the least.

              freeman arguments can be very interesting ....sadly they all to often get poor results, often there arguments to common law end in disappointment when they find the law they shout on, has long since been rescinded.

                I hate to be the one to disagree with everyone else but the bailiffs were NOT acting outside of their powers, so the police officer couldn't act! they are allowed to enter a property through an open door or window as long as they cause no damage in doing so. Once they have entered once they can re enter without permission. Nothing the officer can do! also the cameraman is wrong to say that he can't be sent to prison for refusing to pay council tax as he can! (although this rarely happens)

                  However, Uptomyeyes, the alleged "Notice of Distress" the Marston thug was waving about has about as much authority as my right buttock. As stated above, a lot of Marstons' alleged "warrants" are forgeries they knock out on their PCs back at the office. Ask any of them to produce these "warrants" they claim they have and they become very aggressive.

                    There is one video on youtube BB where a bailiff stands around on the property for at least an hour and a half,,with 3 coppers there and it turned out to be quite nonsensical in the end,,,,but all credit to the cops they kept mostly quiet,but what a shocking misuse of public money and the 3 cops actually look mindnumbingly bored ..

                      also another company rossendales on youtube was apparently stripped of his certificate for misuse of powers, yet thisperson is still has a certificate and still works for Rossendales, and yet after last years panorama about that rougue baliff and miss I own the company I am female bat my eyes and everyone will beleive me , recons that Boast Bloke was the only rogue bailiff they had.

                          I think you'll find, Messi, although he was found guilty of misrepresenting his powers, all he got was a £30 fine, which came out of his bond. What has happened recently, at Bournemouth & Poole County Court, is a bailiff had their certificate discharged by the District Judge there, apparently, without any hearing. Their transgression? The bailiff besieged a seriously-ill person's home for five hours, lied to the police that they were a court bailiff and the police had to help them gain entry and it has transpired that the LO they had with them was a forgery (HMCTS confirmed no LO in existence.). The householder sent witness statements, a copy of the police report and video footage to the DJ. Not surprisingly, the bailiff was sacked by their employer, Ross & Roberts.

                            I think what has to be remembered is that this may ONLY apply if ALL of the persons present, who are purporting to be bailiffs lawfully performing their duty, have the correctly and lawfully executed authorites to do so. If the coppers attending are not able to competently ascertain this authority - or choose not to do so - then they are aiding and abetting, surely !!! If some bloke enters my home uninvited at stupid o'clock in the morning, and I call the police, then I would expect them to AT LEAST check who he is. Asking him "Who are you ?" and accepting his reply "It's OK., I'm a bailiff - just doin' ma job, officer," is NOT enough.

                            The police have to do THEIR job, which is to check the truth of that statement which, in the circumstances, is VERY important, IMHO. If they are unwilling or unable to do so competently, then they are failing in their duty, I believe. Likewise, their Chief Constable who - by accepting that rank, accepts the responsibility for his officers' conduct and training - is responsible, I humbly contend.

                            If we have a situation where any thug or crim - who simply SAYS he's a bailiff and produces a Photoshopped forgery - gets police assistance in what may well be an assault and a burglary, then I think we have a very serious problem with policing.

                              It doesn't show his police force in a good light either. That could amount to Discreditable Conduct or Conduct Likely to Bring the Police Service into Disrepute.

                                I think it safe to say there is a judgment against you.... and ask the follow questions to enable me to get a bigger picture of the actual offence and how it has reached this stage

                                1. were you aware to having traveled on a train without ticket? if yes.....
                                2. did you receive the fine as a fixed penalty? if no.......
                                3. were you sent a summons to your current address?
                                4. You mention a disability..can you elaborate on that please as it may be relevant to enforcement actions

                                Thanks once again all for your responses and sorry for the late reply, in answer to your questions pepsie..

                                1. Yes I did travel on a train around 7yrs ago and I had lost what little money I had me at the time so the ticket inspector allowed me to travel providing I showed him ID so he could issue me a fine.
                                2. Unfortunately I cannot recall what kind of fine I received at the time if any from the train company.
                                3. I do vaguely remember getting a summons at an old address(not sure if it was deffinetly for the train ticket as it was some time ago) to my knowledge I've not received a summons to my current address but could have done and may have been genuinley overlooked.
                                4. Sine birth I have had a rare genetic muscular tensioning syndrome called freeman sheldom syndrome http://en.wikipedia.org/wiki/Freeman–Sheldon_syndrome which in my case affects my hands, feet, back, shoulder and neck I also have mild scoliosis which gives me frequent upper body pain, I have had to leave my job of over 3yrs at asda under the advice of occupational health due to the fact it is a gradually worsening condition and was affecting my work capabillity.

                                Also I have not had chance to contact the courts today to enquire weather it was a judgement or Warrent issued to me however my mother did contact her bank to request that the funds she has paid to these people be reversed but they just said she needs to get in touch with 'the merchant ie marston.

                                I was thinking maybe I request a statement of fees charged by marstons if that will be worth anything to me as I pursue this matter.

                                I have been so angry at these people taking money from my mother but even more so with myself for not being clued up about these people before and wasnt knowledgeable enough to get my camera out and film them and my dog protecting her property.
                                But low and behold this morning I received a Equita Removal notice letter through my door stating I have failed to clear and outstanding balance due to Manchester city council which I'm assuming their implying is for council tax whom I have spoken to and paid the £11 they had requested.

                                My camera and dog will be paitently awaiting their proposed arrival.
