    Hello fellow debters,

    i am having a debt collector comming from chandlers today as arranged and i did debate weather or not, but he seemed civil on the phone but we will see. i am going to document it so maybe it will help you guys and girls.

    ok maybe i should start from how it came about: il try keep it short and sweet.

    received court letter, had to go or go to excheqer house and arrange payment, could not attend either, had work commitements and my partner was ill at the time. so phoned them 3 times explaining why i couldnt go, and ask for call back. no call back, court date came then they decided to deal with it in court without me and the set the ballifs on my home.Chandlers.so chandlers sent me a letter saying i had 2 weeks to pay up or risk my goods. so i wrote them a letter,did my own means test and waited to hear from them. 1 week past and the letter arrives, "thank you for your letter, we have accepted your propose offer, please contact upon this receipt of this letter to give them a date when i could start making payments." now id made a mistake in my calculation so i phoned them and tried to give then another figure and that was met with "no", the girl then said i had to pay to set the arrangement up, but i couldnt give her a defo date when i could do this, so could i pay online? yes you can she said, you have your details on the letter to sign in, great il do that then, got the money but i couldnot log in, by this time a week had past, and i couldnt phone them ,phone cut off, no cred for phone,money i had was to get me to work on the bus. so i emailed them explaining, they replied, you can log in now but we dont accept arrangements on the phone or emails in the office, it will just come of your bill, shall an agent call you? er yeh, i suppose so i can set "an arrangement" up as they put it. so an agent called me, 1 week later, i told him whats gone on, then he had to call me back coz he didnt know what was going on, so called me back and said the arrangment had "expired" for want of a better word, what expired???? nothing in the letter saying i had to pay in such n such a date. just to pay and set arrangement up. which i tried to an extent. so he is comming round tommorow(fri 16th august) at about 8 am, now ive read the comments and stuff on here about they can and cant do, to be honest i just want to get this sorted, im not going to get into a cat and mouse chase, not fair on the kids, he seemed nice enough and but we shall see tommorow, hes comming to get a payment and set up an arrangement to get the balanced paid in 6 months and do an iventory, basically hes gona right a list of all the things he can take if i dont keep up with the arrangement. so if i dont pay, my gear is fairgame, and coz ive let him in he can come in when he feels like it. Now some of you probly think im mad doing it, but he did me a favour i think, coz he phoned me the day before to let me know when he was comming, so giving me enough time to , lets say "spring clean" my house with all the expensive stuff i have( that should take about 2 seconds) only leaving the crap stuff that aint worth alot. hes welcolm to it

    (just had a thought, if you want to get rid of all your stuff in your house to make way for some new stuff like sofas, then let the ballif take it!! cheaper than hiring a truck, and when they leave with your old **** stuff, you can call the new stuff in, imagine the balliffs faces,lol)

    er right, sorry this is serouis.
    so hes comming tommorow and i will be aving words with him first before he steps in my gaff, and i have armed myself with strong words like, regislation 1992, law so with all good intentions if he trys his luck with charging me £80 for a visit fee he will be told he cant do that, but if he does il get him to right it down and sign so i have proof that he tried to con me, i will also call the police. if hes harressing me etc. i want to do this in a civil manner, but im not going to let him intimedate me and scare me in to stuff i dint want to do, so my advice is know what they can and cant do, and let them know you not to be messed about with. thats why im going to document it, ask him his name, see photo id, make him feel uncomftable,copy his id on my 3 in 1 printer on the scanner, oh wait, no ive hiden that, oh well you get the picture ,end of the day s hes in my manner and that im watching his every move, but the main thing is to get this sorted out in a good way.make the arrangent and pay on time, i can still make payments online, and pay the council online and there take it off the bill, well they should, and i just remmembered that ive paid £130 on my council tax bill before it went to this, i might bring that up.
    anyway we shall see what occurs and i will let you know how it goes, im hoping my experience will help you guys and girls.


    ok so the man from chandlers arrived at 7.30am, told me he would be here at 8.30am, should of expected that really, ask him to give me alf hour so i could put some clothes on, but he said the quicker we get this done the quicker he would be gone, so ok he goes, i let him in and asked him to sit down whilst i got dressed which he did, he wasnt rude or nasty. i offered him a cup of coffee which he accepted, he explained to me why he was here and what the debt was about and who he was representing, bromley council.he then asked if i would like to set up an arrangement, i said yes. so he began to sort out writing the paper work and told me what was owed and that it had to be paid in 6 months, so what ever i paid to today, the more the better as it would lessen my monthly payments.so i paid £150, which i said i would want a receipt obvouslywhich he would give me, he then got up and started writing his inventory, noting al the things he would take. now he could of taken them there and then i supposed but he didnt, he then showed me the list and explained to me that this is stuff he will be entitled to take if i did not make my monthly payments on every month, he has the right to enter the premises with or without my permission with police or without to take the goods. he did not go upstairs or the garden just had a look in the front room and kitchin, now heres the list of what he wrote:
    NEC flatscreen television
    2 cloth sofas
    metal glass dining table
    wooden tv cupbaoard
    asko fridge
    microwave
    indesit washing machine
    and my laptop.

    i then signed this, either way i sign it or not, he can still take the stuff and more now i have let him in, remember i want it to be civil and less stress as possible.

    so the total amount outstanding then after everything. council tax £1427.03, levy fee £64, walking possesion fee £12 total, so total amount due, £1503.03.
    first payment of £150, then monthly installments of 225.50 to be paid before or on the 30th of every month. if i miss a payment, then there gona come, if im late on a payment, then there gona come for the stuff. its that basic so i must make sure i pay them. he also explained to me that when we pay them they pass it on to the council to pay the bill, if i pay the council any money and not the ballif then although the council weill deducted it from the bill i still need to make sure i pay the agreed £225 a month or they will come for the stuff coz ive broken the arrangement, so although you can still pay the council, your better of just paying the baliff straight with anything. i cant pay the balliff £100 and say but i gave the other £125 to the council last week, even if you have a receipt, coz thats gong back on the agreed arrangement.basically just pay the ballif and not the council.

    he was very polite, but direct, not interested in your hardship etc, hes there to collect the outstanding balance thats it. but general his conduct was very nice, and was helpful to me with the information he providde and was all sorted in about 30 mins.

    i hope that will be helpful to anyone expecting a visit from chandlers, now i might of been lucky and got a nice baliff,or it may of been that way i was co-operative perhaps. who knows, just thats my experiance with them, just make sure i pay and then ill be ok, in the meantime get your benefit claims in as soon as poss, i didnt claim housing or council tax benefit coz i work full time, but i am on a low income so i may be entitled to something, maybe not but wont hurt to double check. if i am i could get my payments back dated, so i might not owe them anything if awarded.have to wait and see on that.

    i could challenge the £64 levy fee coz im sure there only allowed to charge £24.50 for the first visit and i dont think they can charge me the walking possesion fee of £12 at the same time as the first visit, but hey, im generally happy with the way it went and im not going to rock the boat, so lets see what happens, any changes il let you know, and if i get the housing benefit.

                Do you know how much the Liability Order was for? Is there only 1 Liability Order? How many times has the Bailiff visited?

                There is no law that says you have to deal with or speak to a Bailiff. You are better off ignoring them and paying the Council direct via online banking, Council website or automated phone service. You may have to budget for lawful fees but providing you deny him entry to your home or on anything outside these will be capped at £42-50.

                Regardless of anything he may say he has no automatic power of entry, he cannot employ a locksmith or force entry. Bailiffs lie, cheat & bully.

                  I think i understand what you mean but to anyone thinking of going down this root is this, you offered payment and they accepted. By doing this you entered into a contract hence 'offer & acceptance' contract law. Now, concerning the old stuff they can take away which would help you clear the stuff you do not want and then bring your new stuff in wouldnt cover the cost of the debt, so the bailiff would attend again and again should you fall behind.

                  Do not try these things as bailiffs are a company that trade for business, i have said and said several times DO NOT COMMUNICATE OR CONSENT TO THEM.

                    i know he cant do nothing if i dont let him in, but i want to resolve this issue, im trying to be co-operative, if i make it difficult for him, they will make it difficult for me, theres nothing in my house worth anything, i can still pay the bill by all them ways.its important i get this debt cleared. there only start putting notices onmy door and probly stalk me, and im going to be at work, and my misses is going to be at home alone so theres no need to put that stress on her and the kids. im clued up at what he can and cant do, so if he tries anything silly an abuses the power he hasnt got then he will told and reported etc, if its civilised then it should be ok.i hope.

                          , nah, life is too short to worry yourselve sick, its only money at the end of the day and stuff, that can all be replaced in time.pick yourselve up, dust yourselve down , get your head down, work hard and learn from your mistakes and build up again.

                              I like your optimism to 'civilised' but...they have already succeeded with their objective to getting you to pay them and their fees through scare tactics. Imho it would be better to follow the guideline and put pen to paper to gather the information suggested by PT in post#8 and as this will need to be followed with a request for a breakdown of the bailiff fees, you have the option to take them out of the equation and start making affordable regular payment direct to the Council using their online system.......doing that then removes any suggestion you are 'willfully refusing to pay', halts any committal proceedings, stops goods being levied upon and leaves you with £42.50 in total to the bailiffs fees??
