  • Certificated/Private Bailiffs and what your not aware of

I have noticed some very good advice within the forum concerning members who are basically terrified of bailiffs attending to remove goods. Don't be, you have the power not them, without your permission/consent a bailiff has no power whatsoever.

My advice will give you an insight into what the law regarding traffic enforcement agencies, local authorities etc will not, for the simple reason of revenue. I cannot reveal my sources for genuine reasons but I can tell you this, they are practising law including a very good friend who is doctor of law.

Most of it is pretty straight forward regarding the issues involving certificated bailiffs, pcn's etc. It all started with a family member who did not pay a parking ticket and eventually bailiffs attended. They were unsuccessful I'm happy to say and so were the council, the only difference between you and me was the fact we had first hand advise.

If you are in this situation regarding bailiffs then it would be advisable to pay the pcn directly to the council even if it has gone into the hands of a bailiff, but you are not permitted too, only, if you are aware of the remedy you have which is consent.

Any questions then I will do my very best to answer.

One thing that we are all agreed on....BAILIFFS LIE... blatantly and brazenly. Local authorities and government departments come a close second, along with DCAs. They don't seem to like it when they realise you know the law just as well, if not, better than they do. Certificated bailiffs are the worst. Colourful language is not uncommon.

I would be interested to hear your view on an incident involving a certificated bailiff who forced their way into a person's home, by assaulting the person's daughter, then proceeded to extort £645 from the person's daughter despite that fact the person had paid a fine in full, a month previously. HMCTS, having been told what has happened, are now desperately trying to cover their backsides by refusing to let the person examine the warrant. The bailiff has claimed the court had not contacted the bailiff company.
Life is a journey on which we all travel, sometimes together, but never alone.

Were there any witnesses to the assault? Or should I say aggravated burglary? There appears to be evidence here of what was the bailiff doing at the premises as the fine had been paid. Did the bailiff get arrested?
