Thank you for taking the time to read this, I have read through some of your threads but cannot specifically see how to move forward with my issue.
My husband received a parking fine (council issued) and didnt pay it. As the car is in my name it has all fallen on me. When I received the first letters from Equita there was no amounts etc, so I fell into the trap and rang them, I paid half the amount they were asking for £80 ish plus 1 letter, so around £92.00 and said I would call back the following month with the second half which was agreed to. However this week I have been away and on my return I have a Bailiff Removal notice from them. I work in a law firm in the same department as debt recovery, although don't do it myself, so know most of my rights etc.
I know not letting them in and not signing anything limits their powers substantially. My issue is that the amount written on the top of their notice is £361.84. I have seen their own website limits their legal charges to the original debt (now half, plus 1 letter, plus a max of £28.00) coming to roundabout 80.00.
I am guessing first thing TUesday morning the bailiff will be back. Although me and my children are out all day, I am guessing they might come early morning when my car will be here, it is not on HP and is in my name, and as we live on a small close would be hard to park away from my house. I haven't got a problem with paying what I owe, roughly 80.00, but am worried that this bailiff will demand the amount including the illegal charges or will take my car. I don't have family I can turn to to pay on a credit card, and dont have 360.00 to pay and then try and claim back. I am stuck as to what to do now, I was considering ringing the bailiff, but am worried I might just let my desire to sort this out make me look like an easy target.
Any ideas - would emailing Equita help?
