I just found out today that Bailiff company's can be as conniving and deceitful as the thugs they employ to come kicking down your door. You may have won the game, but not the match. It's time to up the ante.

They have only managed to lose a £10 postal order that was crossed and made payable to them. The said postal order was wrapped in the SAR and sent recorded delivery. In the SAR the words postal order and fee of £10 was mentioned several times, yet they respond with Please advise how you sent the £10 payment for this information to be supplied I'm guessing the office junior knocked the letter up but I could be mistaken. I supose it must be an awful lot easier to "lose" a payment rather than comply. More than one way to skin a cat as they say.

How can an office lose a postal order? Still its evidence for you that they are incompitent!

I'd be even more inclined to see whether it has actually been cashed!

They have a habit of waiting quite a long time to cash the postal orders, so I'd be surprised if its been cashed yet.

With me, I squeezed an extra £60 out of them at the very end over this issue, rather than raise it immediately. It thus cost them £50 to stop crimminal action. Had we not needed the money so desperately, I'd have gone for the criminal proceedings.

I'm not sure how PO's work, but I would have thought that you can now try and use your 'counterfoil' of it to see if it has been cashed. If not, then cancel it and get your £10 back. If it HAS been cashed, then tell the DCA that you will be getting the police involved !!!:mod:

                    Re: You dirty rotten Liar

The PO can be traced through the post office, but i doubt its been cashed just yet, see Labman's post above.

Would the same apply if the company you sent the PO to applied it to a disputed account and then say they had not had or could not trace the request for CCA?

The letter has been received and i have had written conformation of this, also the SAR states quite clearly (several times) what the payment was for.

And yes DT i would say the same would apply. A valuable lesson learnt ..................... Staple all payments to your corresponding letters :tinysmile_hmm_t2:

It is another company and its not clear if they are DCA or soliciters, so far they have not proven that they have authority to enforce.

Sadly, as you are discovering, that is not proof it was in there. When I sent my second one I videoed the postmaster putting it in the envelope and sealing it. At least I had proof then, but ridiculous the lengths you have to go to just to cover your own back.
