  • Bailiffs rights at new address

    If a bailiff has had a walking possession order at a previous address, have they the right to do the same at a new address, after a payment was missed, he has rung them to say he cant afford it this month,
    My son mistakenly let them into his old address after the bailiff agreed a payment with him, but of course the bailiff lied about the agreed payment and my son was hit with a demand for a lot more money
    My son has been paying this amount regularly, but has since moved,
    He is going to have to miss this months payment after a blunder by the CSA [which i will put in a different post]
    He doesnt know whether the first visit still counts or if they can do the same at his new address
    The bailiffs were Rossendales, [need i say more] who have added hundreds to his bill in charges, even saying they had brought a van when they hadnt
    Advice appreciated please

    If goods were levied at the old address then technically they still 'belong' to the bailiff that is if a WP was signed. What is more important is that you say
    the very reliable honest and upstanding bailff firm Rottingdales have added hundreds of pounds to the debt, now I am sure their one rogue bailiff has left the building, but should this be a trainee of that bailiff we really should look at how those charges have been arrived at. Can you tell us what the debt was for and it would also be interesting to see what goods this bailiff has listed in his levy.

    Of course if the levy contained items which at the time were in working order and as time has passed they coughed and died............

      Thank you for your reply, my son is going through all the charges, and they were mainly TVs
      I will post again when he has let me know what the charges were and what for

        not entirely sure but i beleive the bailliff would have needed a new warrant to serve on another address,this usually needs to go through the court system ,usually prompted by the "creditor"
        i am sure if this is incorrect someone will point this out,
        were the court bailliffs or "other"

          The bailiffs were from the council, it was for council tax arrears, his wife was supposed to have paid it and she didnt,and didnt tell him,
          At that time they were living in a furnished house, so only had a few items of their own,
          The bailiffs dont know he has moved yet, as the marrige broke up, so now he is in a small flat
          He was wondering if they could find out where he lived now through the council, he didnr let them know as the money was being paid regularly,
          He has been paying to first wife through the CSA who have been taking more than they should, because the first wife claimed she had no income, and she actually works as a teaching assistant, he has told them this, but it has been ignored, so has the fact that he had 1 child living with him,
          Sorry, i am going off track, but that is why he cant pay the bailiffs this month, because of a blunder [AGAN] by the idiots called the CSA
          I am waiting for him to let me know what the charges were from the bailiffs,i know for a fact it was much more than they should, because i checked what they should have charged, but cant remember offhand

            Look here ---> link for a schedule of the charges the f:censored:g bailiffs may lawfully charge.
