    last yr 2011 june i was issued a fine from magistrates court from vosa.i was fined 422 pounds and ordered to pay 5pound a week however in september i fell 2 wks behind although i paid 20pound to bring myself bk up to date the court wouldnt accept this saying they had already sent the debt to philips bailiffs.In october philips contacted myself saying i needed to pay this debt in full immediatly i explained i was in reciept of benefits and couldnt do this .i made an offer of 5pound a wk which they refused saying they wanted 20pound a week i agreed even though i couldnt afford it they added 200 pound on top for the changeover . Since 11th october 2011 i have paid every monday exept i should have paid on 10th feb 2012 and due to a bereavement i paid on the friday 4 days late .they have now added another 200pound bringing the debt bk up to 385pound they are beind very demandig since february wanting full payment even though ive written several letters swayig ther being unreasonable . i have continued paying and the actual fine is now paid we have asked to have the matter reffered back to court for unreasonable addons 400 pound they have put the phone down on me 3 times i have asked for a breakdown of payments but still abbuse can anyone give me any advice harrassed

    Did they add £200 or £215?

    have you asked to see the distress warrant? If not you should do. He does not have to have it with him, but he must tell you where and when it can be inspected. He must also tell you how much the levy is for, why it was incurred and show proof of his identity. Make a note of all of these. Sadly many bailiffs fail to show the distress warrant - it is hard to understand why if it is a valid one.

    They have the right to charge a one off £215 Attendance fee, but if this has been charged twice, you should complain to the Court Manager. Prior to this it is worth getting a breakdown of the bailiff's fees by sending them this:

    To:
    Acme Bailiff Co
    Bailiff House

    Ref: Account No: 123456

    Dear Sir,

    With reference to the above account, I would be grateful if you could provide me with a breakdown of all charges incurred.

    This includes, but is not necessarily limited to the following:

    a the time and date of any bailiff action that incurred a fee or charge.
    b the reason for the fee or charge.
    c the name(s) of the bailiff(s) that attended on each occasion a fee was charged.
    d the name(s) of the Court(s) at which the Bailiff(s) was/were Certificated.
    e the date of certification.

    f the initial balance, and any amount currently outstanding on the account

    This is not a Subject Access Request under the Data Protection Act S7 1998 so does not incur a fee of £10. You are obliged to provide this information.

    I require this information within 14 days.

      thanks 4 your reply yes they have charged me 200 pound on 2 seperate occasions and ive asked for a breakdown but they keep saying ive not contacted them i have all my reciepts and have photo copied all corrispondence with them ive also asked for it to be sent back to court the fine is now paid and i ow 20 pound on the first addon but now therve added a furthur 200 pound so its gone back up again im not going to pay the last addon because i was only 4days late with my payment.

        Send the letter Labman gave you above by recorded delivery, that way they can not dispute receiving it as they will need to sign for the letter when it is delivered to them. You will also have prove they signed it (keep checking royal mail site using the tracking number of the receipt the post office gives you, and print off the results).
