    Rifty,

    Did you send the letter I suggested you send to the Head of Revenues? When did you send it? Have you chased it up?


    We really need to resolve this properly, once and for all.

    Please confirm:

    1. You have settled the debt in full.

    2. Whether or not you phoned the council to find out how many Liability Orders they have and the amount of these?

    3. Whether or not you sent the letter to the Head of Revenues?

    4. How you asked them for a breakdown of their fees?

      5. Have you yet requested a chargeback by the bank or do you mean to rely on the "honesty" of the bailiffs to refund excessive fees?

      If they've got your money, they won't be eager to provide the information they are legally obliged to provide.

        hi all, yehh i sent the break down letter to phoenix,its mentioned in another post on this thread,,,and i got a reply.......levy£35......attendance/van£110,,,,as i said,i rang the office last night and got told a load of old crap,,,they said the next stage was a letter to be sent to a manager of the company,which ive sent today to ask for an explanation of the fees(recorded delivery)....there is still an outstanding balance on the account,if you include there rip off fees,,,for £110...not sure if i should pay it then try and claim it back??...i could get more visits and more fees?????doors a locked,,,,thanks all......

          I know you're tearing your hair out your end, but it's really difficult to help you without answers to questions.

          I asked you five questions above, one about the letter to Head of Revenues and four numbered ones. You've only answered Question 4 before having a rant (albeit well deserved!)

          PLEASE can you give a straightforward answer to the other questions, then we can try to help you.

                  It's not a problem. Believe me, I know from personal experience the stress you go through with bailiffs. We just want to be able to help!

                  Hopefully the Head of Revenues will reply shortly - they're normally pretty efficient. Don't be surprised if s/he sticks up for the bailiffs, this is not a bad thing.

                  You do need to phone the council - as you say, a job for tomorrow.

                  The breakdown of fees was from the bailiffs. It is these fees that should have been mentioned in the letter I posted up for the Head of Revenues. If you sent something different, it would be worth sending the template I posted a few posts ago, with the fees from the bailiffs put on the letter in the relevant part.

                  Also, I hope you are continuing to pay a regular, affordable amount directly to the council either online, or via their automated phone system. This shows, importantly, that you are willing to pay the debt rather than trying to avoid paying it.

                  The bailiffs have not yet gained peaceul entry or got a valid levy on any property, so they will not break in. They have to go back to court to get permission to do this anyway, and it is almost never granted. Just keep them out, and they will eventually return the debt to the council.

                  What we do want to sort out are the unfair fees charged, so if you could sort out the couple of bits missed, it would be great!

                    just got off the phone with the council for my liability orders,,,theres 10 of them,,here is the list.

                    25th/11/1998...............£0
                    15th/5th/2002..............£276.89,,inc £50 court fees
                    22nd/1st/2003.............£10.00,, "
                    19th/1st/2005..............£363.85 "
                    19th/3rd/2007.............£349.61 "

                    i sent the labmans letter to the head of revenues with the phoenix break down,but not heard from them yet...

                    now here is a strange thing,,when the council sent the account over,and when i got the phoenix breake down,they have paid them selves there £145 fee,,,and when i got my new council tax bill,it shows the £110 thats still owing to them from the last year,,,,,so phoenix have paid themselves there fees before they have recovered the full amount......so there we have.
                    anything else i can do at this stage,plz let me no...........thanks labman,and everyone else.....im calm today...lol

                      Brilliant - well done you! It's hard to get your head together when you've got bailiffs on your back, so I genuiinely admire what you've achieved today, well done.

                      I think you should also be congratulated on having the most impressive list of Liability Orders I've seen!

                      It is normal for bailiffs to take their fees before they pay the council unfortnately. It is particularly unfortunate if their fees are incorrect.

                      I'll have a look through the LO's later on and post up again.

                      Once again, well done for you achievement in doing this today though, I honestly do understand how hard it is. I only had four LO's against me and that was a nightmare!

                        ha ha,,,,i feel so proud that i reached double figures......life and times of a contractor,you never no where your next wage is comming from.....they got paid in the end.....would love to no if phoenix have kept there records regarding my previous accounts with them,,,as in to look at fees,,,,but one thing at a time,,,cheers labman...

                          That one cannot include court fees unless the alleged debt had been minus £40 - an overpayment by you, in other words.

                            1998 does seem along time ago,not sure why the council gave me a zero figure from 1998,with a court cost,,,hmmm......do i deserve some sort of leagle beagle award for having 10 liability orders,,labman was quite impressed..lol.

                                Just had a hand delivered letter from a bailiff, Intention of Notice to Remove saying 'I have attended your premises as you have broken your walk in possession agreement and if you do not pay the balance of £110, I will have no alternative but to reattend your premises with a locksmith and police'. Decided to ring the bailiff and mentioned that I didn't have a walk in possession agreement and he gave up on the spot without a fight!
