    this is never ending! thank god i found this place!

    I've now been issued with a letter today saying reading council have a warrant of execution for 4 unpaid traffic fines (bus lanes).

    the letter says I now have 8 days to pay in full (£441.76) or else a bailiff will attend and debt will go up.

    i cant even argue this one, it totally slipped my mind, i was working there and did a bus lane contravention 4 times in the one day! nightmare!

    but, the debt agency says i cant come to any arrangement at all, it ahs to be paid in full.

    is this right? or is there a way to go to court and ask for a payment arrangement? im happy to pay, just cant afford it in full in 8 days time, and def cant afford for fine o go up if a bailiff attends!

      Which debt collection agency (DCA) is involved and which bailiff company (if any) is involved?

        there isnt a bailiff at present, and the agency are called 'collect services'.

          If they had a warrant of execution it would be with a baliff company which is what Collect Services are - Request a breakdown of the fees and a certified copy of the warrant of execution too otherwise your not paying anything. Also when you know the fees they are charging come back and let us know, as they may not be lawful.

            Collect Services are bailiffs. What does it say on the actual traffic violation?

            I assume you received a Penalty Charge Notice which you ignored? What was the contravention code stated on the ticket?

            To date, they are only allowed to charge £11.20 for sending you a letter. We need to try to stop that escalating.

            Can you supply:
            Confirmation it is a PCN
            Contravention Code
            Exact date of offences
            Amount charged for each offence
            Any other fees - date charged and reason given for charging

            To have a Warrant of Execution the offence would have had to have been a minimum of 36 days ago.

              thanks all, here's the info:


              theres 4 in total:

              1. PCN NUMBER - RG81709655 26/08/2011 FRIAR STREET (WEST BOUND). £110.44
              2. PCN NUMBER - RG81712591 26/08/2011 BLAGRAVE STREET - £110.44
              3. PCN NUMBER - RG81714134 27/08/2011 FRIAR STREET £110.44
              4. PCN NUMBER - RG81716402 27/08/2011 FRIAR STREET £110.44

              the letter says its the 'enforcement of road traffic debts order 1993'.

              it also says the council have issued 3 notices, I only got 1 (granted i still didnt pay it mind so not sure where this leaves me).

              I was using a hire car at the time.

              I'm accepting I committed the offences, just wondering if there is a way to get teh court to allow me to pay in instalments? I called Collect services and they just said that it had to be paid in full by Tuesday.

              the above is all i have by the way, I dont have a breakdown of fee's or anything like that. There's a letter and on the back is what ive posted above.

                Write to or phone the following:

                Northampton County Court, Bulk Centre, 21/27 St. Katharine's Street, Northampton NN1 2LH. (Telephone number: 08457 045007))

                Ask them for Froms TE7 and TE9, or PE2 and PE3 to file a Statutory Declaration, Out of Time Order for four Penalty Charge Notices issued over two days in August 2011, stating the letter says they were issued under the 'enforcement of road traffic debts order 1993.' (I think they actually mean 'The Enforcement of Road Traffic Debts (Certificated Bailiffs) Regulations 1993' .

                You won't need all four forms, but they will advise.

                If you file a Statutory Declaration, Out of Time, you should tell the bailiff and provide them with evidence. On receiving an acceptable application, the TEC will notify the Local Authority concerned, and give them 19 working days to either accept or reject the application.

                If accepted, the application will be treated as ‘in time’ and the Court registration will be revoked. The matter is then referred back to the Local Authority who will decide on their next action. If rejected, the application will be referred to a Court Officer at the TEC for an impartial decision to be made.
