  • unlawful repossession of car under void Bill of Sale

    Hi guys

I recently went to court against Logbook Loans for taking my car when I was not the borrower and lost. My case was one used to give evidence for the OFT in July.

I have recently found out that the BOS used to take my car is void due to the Tribunnal findings.

The Rep that signed the CA also was witness on the BOS so no credidible witness.
Can anyone give me there interpretaions of this

LBO acknowleded in a call that I had an interest in the car but failed to inform me of the repossession.

    1. Can anyone tell me what breech to the CCA it is what section failure to give me notice of repro having third party interest in the car

    2. What sec of CCA breech and enforcement reg if the goods are not at the debtors address and in the possession of a third party what action should have been taken by creditor what the breech is

    3. Can anyone tell me if they have to levy goods by peaceful entry to proterty to remove the car under the BOS. where I can find the ref

    4. I dissputed ownership to balliffs but they carried on and took car. Can anyone tell what sec CCA is this breech ofo and the enforcement reg

I lost and now LBL are going for a charge on my house for £15,000

I brought the case myself and lost.

But they have failed to use legal BOS due to the Tribunel out come in their judgment.

I am looking to go for the Balliffs firm now

please help have days to put this together

    Part VI Section 76(b)

    2. What sec of CCA breech and enforcement reg if the goods are not at the debtors address and in the possession of a third party what action should have been taken by creditor what the breech is I don't think any breach has been committed

    3. Can anyone tell me if they have to levy goods by peaceful entry to proterty to remove the car under the BOS. where I can find the ref Sorry - BOS?

    4. I dissputed ownership to balliffs but they carried on and took car. Can anyone tell what sec CCA is this breech ofo and the enforcement reg There would have been a CCJ first. Bailiffs would have been appointed for failure to comply with the determination in the CCJ.

I brought the case myself and lost. Sadly that is a risk you take when you pursue a case by yourself. The reward can be great, but the cost can be high if you lose.

But they have failed to use legal BOS due to the Tribunel out come in their judgment.

I am looking to go for the Balliffs firm now What exactly are you looking to go for them for? I suspect they will give you plenty of stuff along the way, but be careful. Are you being pursued by County Court bailiffs or HCEO's?
